I have been thinking about what might happen down the road (4-5 years from now), and because it looks like my sister in law will be getting a work visa soon and my wife and I are already in the U.S.... her mom might one day think about immigrating. After all, both her daughters will live and work in the U.S. But anyway, her mom is a semi-leader in local government and so of course is a communist party member. Under section (d)(i) she is ineligible to be granted LPR, but it is my understanding that Chinese that fall under section

(d)(iv) "Exception for close family members.-The Attorney General may, in the Attorney General's discretion, waive the application of clause (i) in the case of an immigrant who is the parent, spouse, son, daughter, brother, or sister of a citizen of the United States or a spouse, son, or daughter of an alien lawfully admitted for permanent residence for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest if the immigrant is not a threat to the security of the United States."

enter ap for a period of about a year then are approved. Can anyone shed some light on that? I know she could simply end her membership but that would mean losing her job and retirement. Plus she might not even want to leave China.... Does anyone know if section (d)(iv) is approved very often for parents in China? Thanks

you are in an unusual situation for this board. most American-chinese relationship discussion occurs on candle for love, where you will get a better informed response.

that being said, few older chinese that get green card thru child with US citizenship actually stay in America. most end up going back to china, where they are more comfortable.
