Important notice about k3 visa

Hi all. I generally am not as active these days but I wanted to let you know that I am going to help write an article for VisaJourney on this issue. Hopefully we can raise awareness on this issue not only on the web but to the "decisions makers" and get this fixed sooner than later. Issues caused by the USCIS / DOS that negatively impact families at such a sensitive time (immigration) are something that I feel strong about raising awareness on and getting fixed.

I will post as more as information is available.

NVC is a breeze through if you're quick about it. Have your documents ready and pay the bills on time. It took exactly 13 days from my case # assignment to me getting all the documents out of the door. Now we're waiting for a quick case complete and no RFEs.

The fee payments are $70 for the AOS and $400 for the IV bill.

Thanks all for your advice.

So as I stated earlier my I-130 was received on Feb 1st NOA1 was mailed out on 2/5.

I am going to take the advice given to me here and follow the CR1\IR1 path rather then send in a I-29F. If I am not mistaken I need to sit and wait now for the Srvc Center to process my application and approve it and then send it to the NVC who will send my wife a package which will includes things such as the AOS and other a couple of other forms. Any advice on what if there is anything I need to watch for when filling out these forms.

Also for the police certs how far back do they have to go and are there any differences in a police cert requirement for a man or a woman.

What's wrong? Did you have a question?

If both your K-3 and CR-1 petition was approved after February 1, NVC will consider the I129F to be administratively closed and pursue the I-130. Get your documents ready for NVC. Good luck.

I filed my I-130 form before the deadline and received my noa, which I then copied and sent with my I-129f. they received my I-130 form on Jan 31st 2010 and the other form on the 16th of Feb. Does this new rule apply to me.

Yes. Forget about the K3 and carefully study the CR1 guide. It's not a filing deadline. NVC comes after petition approval, so this definitely applies to you.

Only if you/they don't think it through. We're going in circles. The children issue is going to catch a lot of people with their pants down and delay the reunification of families. Beyond that, the K3 was a perfect visa choice for many who need to freely come and go from the USA for a while before they immigrate. They don't qualify for B1 or B2 visas and clearly have immigrant intent even though not immediate. I've recommended the K3 here in the K3 forum for at least three couples this year already, where immediate immigration was not their intent.

DOS's assertion that the need for the K3 no longer exists when the I-130 is approved is simply wrong in many cases, even if the "many" is a small minority. In those cases, I expect NVC retains the power to administratively reopen cases they administratively closed.

I totally agree that there are atleast a very small minority of cases where K3 might be superior. I am one of those and really lucky because i got the approval for our I-129F petition last month just before the Feb 1st rule came into effect and lucky was able to pursue K3 to apply for our visa at the consulate. I have a little infant daughter who is growing up fast and I am missing every bit of it. So I wanted the fastest possible way to reunite with my wife and daughter eventhough we understand that we would have to pay a little extra when we do the Adjustment of STatus later on. In our case with our criteria K3 was superior because we want to be united in the fastest way and we do not mind waiting a few extra months to get the greencard . So I am a bit sad that now K3 will not be an option for many who are in my situation. I hope they let NVC reopen cases which are administratively closed based on individual circumstances. The only time I will not see any need for K3 is when they can lessen the timeframe for the entire process(right from petitioning to granting of visa by embassy) to about 3-4months for IR1/CR1.

I would also like to add that the most we saved was probably 2-3months going the K3 route and that was only because NVC directly sends the I-129F approval to the embassy thereby saving time at NVC.

I took all original documents with me on my trip to England, thinking hubby would need them for his interview...now I need them back so they'll be ready go to when NVC gets our case...

Wouldn't it be faster & cheaper to get new copies of your marriage licence and/or birth certificate here in US? Thats what I did.
