Important notice about k3 visa

Timeline

I'm just not sure about the K4 process.

Do you think they will continue with K3 in case people have children on their application? Or even give a cr1 visa stamp for their mother and a K4 for the child?

Otherwise it will mess everything up. Should people start to hurry and fill out a I-130 for their children?

I don't have any, just trying to figure this out.

And I agree with Christeen, I think it will probably speed up things a bit!

I am wondering if they will continue with the K3 process where there are kids named on it as these people weren't anticipating having to pay the fee for the I-130 for kids....on a K3/K4 visa, they have 2 yrs to do that (the length of time b4 it expires - at that time, you can send in the I-130, 485, 765 & all other necessary forms, all together - that is what I was told as I have a 17 yr old that has K4 status). I am thinking that the petitions that come in AFTER Feb 1, 2010, must be for the CR1/IR1 process, K3 would not be an option after this date.

Can anyone tell me where I can find info on the fees? I was honestly not expecting to have to pay anything else (or pay anything significant at least) until it was time for his AOS here in the U.S., but I understand that I will have to pay something while it's at NVC stage, correct?

Also, I brought all of our info, original marriage certificate, filled out and signed I-134 form, birth certificate, etc, etc to him in England, expecting him to need it for an eventual interview. Will I need to get any of it back from him now, to send to NVC?

I am completely in the dark about what to do, now that it seems to be transitioning from K-3 to CR-1. So much for trying to be prepared in advance...

Guys I have a doubt here....

If they approve my 129F first and I don't want to follow K3, they will send it to the Embassy in my country then what? I should call them and tell I want to wait for CR1 or the NVC will ignore my I-130 since the 129F it's already at the Embassy?

For the post above me: I suggest you read these two links here about the CR1 and get familiar with them. If you go CR1 you'll have to pay some fees and send the affidavit and DS230 to the NVC, so start gathering all the documents needed for when you petition hits NVC you are able to process it fast.

So I'm a little confused. From what I'm trying to understand, if your I-130 and I -129F have not already been approved and you're not already in the process of working with the embassy of your spouse's country, then we no longer have the option of going the K-3 route? I sent the I-130 application back in October, received the NOA-1 November 6th, then sent out the I-129F (of which I have received no NOA or any kind of response about, maybe because this was already on the horizon at the time). So only three months exactly have passed since the NOA-1 of the I-130. Does this mean I am no longer able to consider the K-3 as an option and that our application is now just strictly for the CR-1? (Been married less than two years) It doesn't really bother me because I was already contemplating canceling the I-129F and going the CR-1 route. I just want to be sure that I don't need to call into USCIS to cancel my I-129F application, since the K-3 route is apparently no longer in existence. Please let me know what you think!

Also, mrs. wife!, it looks like we nearly have the same timeline, with your NOA-1 for the I-130 being just a day ahead of mine. Funny how you've already received notification about your I-129F and I haven't heard a word, which no longer bothers me as I have been already preparing for the CR-1, which seems much more beneficial than the K-3 in the long run. Quick question though, how do you know when your applications have been "touched"? Anyways, I hope all continues to go well with your application and everybody else's application here.

Create a portfolio (if you haven't already done so), the "Last Updated" date is when your petition was last "touched". :star:

Hi Christi, yes you do have to pay 2 fees at the NVC stage. It's $400 for the AOS bill and $70 for the DS-230.

You will need to have all the originals back to you to send it off when NVC bills are paid. Also you will have to file a I-864 instead of I-134 form for the affidavit.

Check it out this NVC guide, it might be a little confusing now, but it's very simple.

And the good thing about going cr1 is that you won't have to spend $1010 when he gets there, just $470 at the NVC stage and he will receive the GC within 6 weeks by mail!

Okay - I'm a goof - I kept posting the URL, and it kept my cookies in there, so I was posting up our info for the world to see...

If you go to the USCIS website, and click on "Check My Status", under, "After I file" on the left hand side of the page...

And THANK YOU Mrs. Wife - it's nice to know the fees will be less, and the wait shouldn't be any longer...I'm coming around to the CR-1 way of thinking...

Hi, it seems you will do Cr1. It's very weird that you didn't receive the NOA1 for the 129F yet. Are you sure they received it at the USCIS? It seems to me that it got lost in the mail or something.

Anyway you will do cr1 then. Check out the NVC short cut guide I posted above and get familiar with the process. I'm already gathering all the documents needed to send to the US, so as soon as the NVC allows us to send it, we'll have it ready to go.

Good luck to you and hope we get our approvals soon! Our timeline is quite the same =)

I know what you mean. When I was told to forget K3 and do Cr1, I took some time to swallow all the information and decide to go for it. I think couple years ago it would be a disaster if they have done that, but now things seems to be pretty fast for both visas. It might take a bit longer (since we have a stop at NVC), put if you have everything ready to go you can make it fast. Also no more paperwork with AOS and interview when we get to the US. We'll finally be able to relax and enjoy our new life with our loved one! - at least for 2yrs though! lol

The issue not being addressed in the notice doesn't mean it hasn't been thought out.

It would not be hard at all for DOS to keep the I129 alive (even if it arrives at the NVC at the same time as the I130) merely by reading the petition. Those I129 with derivative children move on - those without do not.

Our journey together on this earth has come to an end.

Hello all

I am a VJ Virgin so please be gentle with me :)

I have read the important notice and cant seem to figure out exactly what is going on.

My situation is as such I am a naturalized US citizen and got married in Pakistan this past Nov 2009. On Feb 1st 2010 the Chicago office received my application I submitted for my wife's K3 visa. I checked this morning and the check has cleared, I am assuming they have accepted my application. I have not received the NOA yet but figure it will be here some this upcoming week.

So I have two questions I would love answers or direction for

1 - Them cashing my check does that mean my application has been accepted and they will start processing it?

2 - How does this new "Rule\Process" impact my K3 application for my wife. Do I still send in the I-129F once I get the NOA1 for my I130 or do I need to follow a different route.

I would be grateful if someone could decipher all this for me into layman's term.

CRUD...I am totally at a loss as to whether I should ask hubby to send all of our paperwork back to me ASAP, or if I should have him keep it all there just in case we continue to go through as K-3...

Well, I guess, worst case scenario, I'd have to send it all back to him again. Theoretically, if we go through as K-3, I'll have more time to get it all back to him, than if we go through CR-1 and I have to start assembling info to send to NVC as quickly as possible...

Hello all

If I were you I would NOT send the I-129F. The K3 is obsolete, stick with the Cr1. Just receive the NOA1 for the I-130 and wait for the approval. I sent mine because I didn't know K3 that was so waste of time and money back then!
