I'm curious to see what the responses are because I'll have similar situation with my fiancee's daughter...

One thing I do know is that if the birth father is in the picture you'll need his permission for the adoption to occur (this permission is different from the approval that the birth father may have given for the child to immigrate to the USA).

Is the birth father listed on the child's birth certificate? I'm fortunate because in my fiancee's case the father's name is not listed and my fiancee has sole and complete custody of her daughter.

Timeline

The birth father is not in the picture, they are divorced and the mom has complete custody of the child. He only has visitation rights but he has not visited his daughter for over a year now, and has not even tried to be a part of her life. We did not need his permission for the K-1 visa approval either. The Father is listed on the birth certificate. If it matters any, they are coming from Indonesia.

Check you states laws on adoption. Many have a set time that the step parent relationship must exist before you can adopt. In California it was 5 years when I looked into it. Try this site step parent adoption

This will not be over quickly. You will not enjoy this.

I adopted my stepdaughter here in Hawaii. She came on a K4.

Hired a lawyer for $1,000 and a month and 1/2 the adoption was final.

Easiest thing I've done in the process.

She automatically qualified for US citizenship after we were married for 2 years.

NO NEED TO ADOPT HER CHILD.IF YOU GET MARRIED WITH YOUR FIANCEE (CHILD'S MOM), THEN YOU WILL AUTOMATICALLY BECOME HIS STEPFATHER

the child is coming on a K2, you should file the child as a stepparent. No need to adopt him/her.

I haven't been on VJ in a long time. However, one of my last posts was after I brought my fiance'/wife and daughter to the USA and the endless chain of paperwork, they both got their green cards. Before the daughters green card expired, I did a legal name change/adoption in our County Courthouse, no atty, for around $150.00 or so. Once we got that done, I sent in a form N-600 for her and the regular Lifting of Conditions for my wife - plus the $$ required for each. We just received a letter yesterday, almost 2 years later, that my daughter is going to take her oath later this month and become a US Citizen. There is a way, but it's not any faster or less expensive. Good luck to everyone out there.
