Question on I-864 and No Tax Return

Hi There!

I'm asking a question for my cousin.

He is USC and was in the Navy for 7 years. Since he left the Navy he has been living off the GI Bill Education Benefits. He makes around $1700/month and this money is tax free. He didn't file a income tax return for the past 4 years.

He is married to a B1 holder and they are applying for AOS.

What do we do about his I-864 form? He has no Income Tax return. Would a letter explaning this be enough?

Should he just leave question 25 on the I864 blank?

They already have another USC who will be a co-sponsor.

Please advise if you've been on this situation or know what to do.

yikes.

1. letter of explanation

2. copies of payment notices (usually the tear off portion of the check, or if electronically deposited, will receive something via paper)

3. double-coverage - get a co-sponser (just in case).

On the letter of explanation - ensure he points out the IRS rule that allows him not to fill out a tax return. (as applicable)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
