I am working now as caregiver to the ailling father of my kind & nice employer, lately i was thinking how to bring my daughter here in the USA, i did ask my employer if he could possibly help sponsor my daughter & without further question he told me that he is willing to help me in any which way he can. My daughter is R.Nurse n Philippines but not yet taken NCLEX exam. My question is, WHAT KIND OF VISA WOULD MY EMPLOYER WILL APPLY FOR HER? I have a strong feeling that an H2b visa would be ideal? Pls vjers give me your smart opinion i need it asap. I dont know yet what to file, my employer is just waiting for me to feed him the information. I dont think i will hire a lawyer as it is so expensive to get one.

Mamalou,

A H2B visa is for work that is seasonal or temporary in need. Most H2b visa employers are resorts/national parks etc... Employers can't use it for a position that would be needed year round also unemployment in the area has to be low. Businesses wanting to use it, have to obtain a labor certificate - which involves a lot of advertising and proving there aren't qualified americans to fill the jobs. Given the expenses its usually used by a company looking to hire many employees not just one. Typically each contract can only be for up to 10 months at a time (with extensions with other employers up to 3 years max.) Usually H2B visa holders switch between ski resorts and national parks. It's a great way to travel. But almost unheard of to stay with the same employer unless they can prove why the temporary position length has increased. The only time I heard of that was Huricane Katrina construction labor. I've heard of it used for entertainers/actors also but never for nursing.

You may want to google visas for nurses. I think you may be looking at a H1C (if still available). Or alternatively look into if Nurses can come under a J1 training internship visa.

Good Luck

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”
