hi everybody

i am permanent residence and my wife's case is in NVC waiting for visa number to become available, and i have new born baby overseas. i just called NVC today and asked them about my wife's case and adding baby into the same case, but i also told them that i am getting citizenship in next couple of months, but the customer service representative told me that if i become citizen then i have to file another separate i130 for my baby, but my question is if i just add baby in my wife's case right now as a permanent residence then do i still have to file another i130 after i become citizen. if anybody have any information that helps please let me know..

Why don't you apply for a CRBA when you become a citizen - basically registering your baby born overseas to an American citizen. We are in the process of doing this at the moment. They automatically get citizenship.

CRBA doesn't apply here as there was no USC parent at the time of birth.

hi

i am confused again i just spoke with one of the representative at nvc about my case i just ask them if i become citizen in 2 week will i have to update my case status or not and they said yes i will have to. i am afraid that if that happens then i have to file i130 separately for my child which will delay it even more, at same time i have paid nvc for my iv bill fee for my child and wife 400 dollars each. so i don't know what to do, because the next step is to send ds-230 for my wife and child. if i will send both ds-230 forms will they be able to work on that case without having me file for another i130. so i am kind a confused there. please some one help me

From what I understand you will have to file for a new I-130 for the baby as now the case will be processed as spouse/child of USC (CR-1/CR-2) rather than spouse and child of LPR (F2A? I think?)

There are no automatic derivatives for the former.
