Hello.

I have been married to my wife for almost a year and we are both living in Japan.

I am Japanese citizen and my wife's US citizen.

We are thinking about moving to the states in two years.

I understand that in order for me to get a permanet ressidency, she has to sponsor me, but she has no income in the US (we are both working here in Japan).

I read that income outside the US is not considered as part of income requirement.

If we would like to file without joint sponsor, our total assents have to be three times than 125% of poverty line, correct?

since her income in the US is zero,

Poverty line for household for two in 2009 is $14,570 (California)

125% of $14,570 is $18,212, times three is $54,637.

Is this the amount of money we have to have at the time of applying for my green card?

Your help or advice is very appreciated.

If you are using assets, generally it is 3x the 125% in a US account... I have heard of some consulates asking for 5x so I am not sure what is the norm for the consulate you are going through? We used the 3x and showed the 56k and were approved...

I'm moving this to the DCF forum because if you are filing outside the US and are legally resident in Japan, you will be eligible for Direct Consular Filing. This is much faster than filing via the US, and there are a couple of people filing via DCF through Tokyo right now posting in the forum who may be able to give you more targeted replies. :)

I am in the same situation but in Mexico. I am the USC and I do not have any income in the US as I don't plan to look for a job until we are actually there. I am also doing only assets. You are correct. In the instructions, it specifically says that if the USC is sponsoring a spouse or minor child, he/she must show 3 times 125% poverty guideline for their household size.
