I'm looking for information on petitions that were sent back to the USCIS from a foreign embassy by mistake. The consulate in Naples recieved my petition last week, saw the priority date of April 24th, and sent it straight back to the US! Nevermind the fact that my petition already included the IMBRA related evidence and therefore should not have been sent back. Has this happened to anyone else? Also, is there anyone who can give me some advice on how to get my petition back on track?! It was sent from Naples on the 20th of July, NVC still has no record of recieving it.

REMOVAL OF CONDITIONS

05/04/2009: I-751 Package mailed to California

05/15/2009: NOA1

06/30/2009: Biometrics Appt Cancelled...

07/08/2009: Original Biometrics Appt

Can these consulate people be more confusing?!?!?!

Or confused. I think they read the first few words of the DOS Notice about IMBRA and then thought that they had to send back EVERY petition with a priority date after March 8th. Nevermind why, they must send them back! I'm doing my best to explain to them what happened, of course I'm sure they will never accept any blame for this. Every place tells me to contact another.

So, I'm putting together three letters, and faxes, to the VSC, NVC, and Consulate detailing my case, what happened and the dates of everything. Sending along all email correspondence, with approval notices and my copy of the IMBRA RFE that I completed. Then, I'm calling them, all the time, until the case is back in Naples and back on track! If it gets stuck anywhere, I'm finding some help from Senators or Congressmen.

All else fails, I'm sending in my angry grandmother, she didn't want me to have a wedding in the middle of winter, so we were planning for the fall :)

You mentioned the Date of April 24 th, well USCIS did not yet have IMBRA Compliant forms until the end of June, Therefore in the eyes of Our ever inefficient Government, You are not IMBRA Compliant, whether You sent the Info or Not. Hate to be the bringer of bad news,

Ours got approved on 4/21 and sent to China where it sat for three months, and USCIS Still has not received it back, Hows that for efficiency,

I allways thought it was not possible to screw up a rock Fight but the US Government will !

I don't completely agree. My receipt date was April 24, 2006, NOA1. However, as many on this forum can attest our petitions were held up at the service centers so that they could send us a questionnaire that had the additional questions on that are on new form I-129F, so that our applications are compliant with the new IMBRA law. The Request for Evidence that I recieved states as such. My application, complete with the additional information, was approved in JULY. I have seen many go smoothly from NOA1, IMBRA RFE, and NOA2 to the consulate and the consulate did not send it back. There's no need to, it has all of the required information. I've talked to 3 different people at the National Visa Center and they all say that there is no reason for my petition to be returned, same with the Service Center hotline, because my petition was still at the Service Center when these new procedures came into place. If your application was approved and sent to the foreign consulate BEFORE the IMBRA RFE's were sent, then it had to be returned so that the questionnaire could be sent.

In any case, it seems everyone is confused by the procedures they put into place for this new law.

I agree nuzzledark, the consulate stuffed up....simple. Calling and emailing all the relevent departments is your best course of action. Just stay on it until the correct thing is done. There was a couple of cases where petitions were returned with the recall, that weren't even under the IMBRA as they were filed prior to March 6. From memory they were rerouted back to the consulate. I think we are going to see more of this happening over the next few weeks especially, until they all learn to read whats in front of them :unsure:
