Public Charge Question

Hello,

My wife entered the US under a CR-1 Visa a year and a couple of months ago. She is now pregnant and her employer is suggesting that she file for disability when she decides to take a leave. My questions is: Will my wife become a public charge if she files for disability? Thanks in advance for any help.

07/01/2008: NOA2 Receipt

08/29/2008: Case Completed with NVC

10/16/2008: Interview Date - Passed

10/21/2008: Visa Received

11/01/2008: Flight to US - POE: SFO

09/10/2010: Mailed I-751

09/13/2010: NOA1 Receipt

10/15/2010: Biometrics Appointment

12/22/2010: Approved

12/30/2010: Green Card Received

03/02/2012: Mailed N-400

03/08/2012: NOA Receipt

04/17/2012: Biometrics Appointment

05/24/2012: Approved

absolutely not a problem if it is an employer provided plan.. the public charge question only refers to government sponsored "means" tested benefits

Thanks for the response. I always thought disability was a state/government provision, not something an employer would provide, which was the reason for my question.

no government sponsored short term disability plan I am aware of....

you need to check if it is "means" tested... if not then it is not an issue

Disability is provided by the employer and in some cases the employer deducts a percentage of the premium payment from your pay check.

This should not be an issue for you.

02-15-2011 - Received interview letter in the mail dated for March 22nd

03-22-2011 - AOS interview date

03-22-2011 - GREEN CARD APPROVED!!!
