Hi,

I was contemplating applying for citizenship until I remembered a DUI from more than ten years ago in college.

back then I was put on probation, successfully completed it, and I was told there would be no record on file. This was also in a state other than the one I resided in.

My question is: Is this still relevant and how do I go about getting those papers?

Any input is very much appreciated. Thanks.

If you have ever been arrested or detained by any law enforcement officer for any reason, and charges were filed, send:

An original or court-certified copy of the complete arrest record and disposition for each incident (dismissal order, conviction record or acquittal order).

If you have ever been convicted or placed in an alternative sentencing program or rehabilitative program (such as a drug treatment or community service program), send:

An original or court-certified copy of the sentencing record for each incident; and

Evidence that you completed your sentence:

An original or certified copy of your probation or parole record; or

Evidence that you completed an alternative sentencing program or rehabilitative program.

If you have ever had any arrest or conviction vacated, set aside, sealed, expunged or otherwise removed from your record, send:

An original or court-certified copy of the court order vacating, setting aside, sealing, expunging or otherwise removing the arrest or conviction, or

Yes, it is still relevant. Write the court in the jurisdiction where you were arrested and where the case was heard. Approach the police department to see if they can provide you with a certified copy of the arrest record. Ask the Court for a certified copy of the court proceedings. If there is no record of the arrest or of the court proceedings (eg. they have been destroyed, etc.) then you need to have the official letters on the Police letterhead/Court letterhead stating the fact that the records are no longer available. Answer all of the questions on the application form correctly - yes to arrest, yes to wherever it seems relevant.

You need to submit originals or certified copies of the requested documents - or the letters that such evidence no longer exists - and provide a clear written summary of events with the application. It will be discussed during the interview. It is unlikely to be a problem, but you do need to disclose the information.

Hi,

Thank you very much for your thorough reply. I was afraid that would all still be relevant and make the process more difficult (not to mention time consuming).

At least now I have a starting point. Thanks again, Leo
