H&R Block said I can't file a W-7 for my wife???

Timeline

I went to H&R Block to file for my tax return. I told them I want to have my wife name on my tax return but the H&R lady told me I can't. I told her that there are ppl fill out w-7. She said my wife isn't here in the US so I can't do it file for w-7. Then she said if the IRS found out that she not here and i file w-7 they wont let her in the US forever??? I think this lady dont no what she talking about.

Yea, that lady doesn't know what she's talking about.

W-7 is the application for an Individual Taxpayer Identification Number (ITIN).

Per the IRS website: "IRS issues ITINs to foreign nationals and others who have federal tax reporting or filing requirements and do not qualify for SSNs. A non-resident alien individual not eligible for a SSN, who is required to file a U.S. tax return only to claim a refund of tax under the provisions of a U.S. tax treaty, needs an ITIN."

--This currently includes the following:

Non-resident alien filing a U.S. tax return and not eligible for a SSN

U.S. resident alien (based on days present in the United States) filing a U.S. tax return and not eligible for a SSN

Dependent or spouse of a U.S. citizen/resident alien

Dependent or spouse of a non-resident alien visa holder

The bold is typically who we married "petitioners" would file for to be able to claim our spouse as an expemtion on our taxes.

Call the number thats on the W7 forum they will give you all the correct info.

She doesn't knows what she talking about. I filed income tax for my wife back in 2008 with no problem, and lot of money back. hihi..

HR Block workers are nowhere near perfect. A friend had them do her taxes last year... she got a letter from IRS asking her or her tax preparer to come in for a meeting... HR Block wanted her to not attend the meeting... they told her it was thier mistake and they would cover the first 5000... but now they are awaiting approval from HR Block management as penalties are accruing... at the time of the meeting it was 6500... so everyday the penaties grow is more she has to pay out...

Whenever I have a question, I just call the I.R.S., they're very helpful, and you can rest assured they are totally aware of the most current tax law. I've already filed Fed/State and received my refunds this year!

I do my own taxes, and don't use anyone's software - I just use form 1040 and file electronically. Whenever I have a question, I just call the I.R.S., they're very helpful, and you can rest assured they are totally aware of the most current tax law. I've already filed Fed/State and received my refunds this year!

I stopped doing this years ago. My taxes have become far too complicated. I would have to invest far too much time learning tax law in order to file an accurate return. I value this time far more than the amount of money I might save by becoming a self-made tax expert. Even with good tax prep software that integrates with my accounting software, it still takes me about 6 hours to prepare a return. I also tend to be conservative with my return. If I have any doubt about a deduction then I don't take it. I'd rather pay a little extra in taxes then go through the time and grief of an audit.

It's also been years since I've gotten a refund from either the federal or state governments. I'm not keen on the idea of giving an interest free loan to the government. I calculate my withholding so that I owe as little as possible at tax time, but I always owe a little.

You're gonna get a hard time, but if you have atm deposit, just do it that way and you should be good. Either that, or you have to change the bank account to include your spouse then the bank will be okay with it.

I recently had problems too, but I just deposited via the bank atm and they havent told me anything yet...

When my wife is not here, no way for me to add her name in my BANK ACCOUNT, I just deposit refund check into my account with no problem. When you deposit without taking the money out. I don't think there will be a problem. I did mine, no problem at All.
