Changing name after marriage

When you get married, you can legally change your name without going to court. Simply use your new name on the marriage documents.

My wife followed the Filipino naming tradition when we got married. Now she has everything in her new name...Social Security card, State ID card, etc., etc.

No problem.

~ Tahoma

Not necessarily true.

We applied for AOS using the Filipino way but our IO would not allow it. My wife's green card was issued with her single middle name and her new last name. We supplied documents showing her name the Filipino way but it did not matter. We decided not to go through the additinal hassle of getting it chnaged legally and will just get bank accounts, etc. chnaged to reflect the name on the green card.

If you filled out your I-485 and I-765 with the Philippine naming convention you should not have any problems. The social security card name can be changed after you receive the green card.

Didn't work for us, sadly.

It appears like when applying for Philippine passport renewal,we have to abide following Philippine name change way. Will it follow doing same thing on submitting the Report of marriage, using father's name as middle name?? One one hand, we follow the US name change way to all our documents such as SSN,driver's lic, bank accnts. city serv. billing ,basically transactions done here in the US, like I do. ^_^

 international Immig.Inconsistencies,just like I-94 :P

Oh my, theres got to be a final way to settle this out  . We need more responses,if not defined ways on how to deal with this.

I need to renew my passport, thats for sure

Howdy! Did she use her Philippine way married name when renewing her passport and on reporting for marriage?

I'll be having my AOS biometrics this February. My passport will expire next year so Im very critical on what to do next.

Hi Tahoma,

This was a great reply on this topic. We need more infos too how you had done. We got wed at court jan.5 and i changed too my name the filipino naming tradition. Now we are gathering right informations and preparing paper works for my AOS application. My husband and I want my new name(married name) in all of the application papers.

My questions is, can i fill up all the forms with my married name without changing my status & basic infos.in my passport? all my identification was in my maiden name. Our bank accounts are on my married name though.

Need also to know how will i get my vaccinations since i never had any when i got my medical axam.(nov.18.2009)for my K1 visa. Any papers to show to the Civil surgeon for the signing of I693 and getting vaccination shots?

Thanks...

Congratulations on your marriage!

Yes, you can use your new married name on all of your documents. Don't worry about your old name on your passport. You can change it to your new name when you renew it. And don't forget to go to the Social Security office and change the name on your Social Security card to your new married name. It does not cost anything to change your name on your Social Security card.

Are you required to get any vaccinations? If so, any doctor or civil surgeon can give you the shots.

Yes, dear when you renew your Philippine passport and wants your married name reflect on it, your maiden surname will become your maiden name and I have had no problem about it with US immigration too by the way. My GC, DL, everything… bears my fathers last name as my middle name. Good lick on your journey.

  • 1 year later...

Much of the name change stuff is state specific. Here in Georgia, when we got the marriage license, the clerk specifically asked my wife what she wanted her married name to be. She specified the filipino customary way.

After marriage, the clerk gave us several certified copies of the marriage license with the new name on it.

Then we went to Social Security and had the card issued in her married name.

Went on the base and got her military ID in her married name.

Filed for AOS in her married name. The NOA-1 and Biometrics letters were issued in her married name. Her interview appointment was sent in her married name.

During the interview, the interviewer changed it back to the US way without our knowing. Her GC was issued incorrectly.

We sent in for a corrected no fee green card, providing all the evidence that she had changed her name. USCIS agreed and corrected the green card free and sent her a new one.

Thanks for this. I just ran into this as we got married. My wife told me about this. We are seeing what we can do on this. It is not something easy for US law to understand. there are many countries with traditions like this. However, the US system is not built for this.

I think it's the same way in California? Unfortunately, they wouldn't let us do that here in Michigan :( We'll either have to wait until I apply for naturalization/citizenship to change my name or just keep my current U.S. legal name (FIRST NAME) (MOTHER'S MAIDEN NAME) (HUSBAND'S LAST NAME)

Yup! That's what I heard - I believe Calypso (a fellow January 2010 AOS filer) was the one who told me she was able to change her middle name to her father's last name in California with no problems. :) I really wish there was a law about letting immigrants follow their home country's naming conventions but I guess it's a small price to pay to be with the one you love ;)

Now this is really interesting. I hadn't heard of this convention thing before.

I wonder how immigration would respond if the beneficiary just said "Nope, I'm not going to change my name at all, I'm going to keep my current name the way it is right now."

After all, millions of American women do it that way.

May your visa journey be smooth and speedy.
