I had a post explaining my problems with husband (usc), he got a girl pregnant back home when he went for a week....

Beside having some problems in our marriage I was trying to make things work, but after the cheating i am heading to divorce..but the thing is in the maryland where I lived to fille for divorce you have to live apart for a year...if I start the procedure now it my take time before I get the divorce and my 90 days windows will start end of february.....

This morning my husband just let me know that he has file for his taxe married file separately....

I am tired please help me......

If a couple is about to split it makes a lot of sense to file taxes separately. What's your question?

You two can file taxes separately, this will not have bearing on your immigration status.

You can file I-751 with a waiver prior to obtaining a divorce decree. Do file on time!

You are not in trouble on either account.

CR-1 Timeline

March'07 NOA1 date, case transferred to CSC

June'07 NOA2 per USCIS website!

Waiver I-751 timeline

July'09 Check cashed.

Jan'10 10 year GC received.
