K-1 Visa process.

Applied and received SSN, in Maiden name, 2 days after she arrived, 12/18/2009.

In Wisconsin, SSN is required for Marriage License.

Got marriage license and got married 1/29/2010, left courthouse with Certified Marriage Certificate.

Went to SS office to get new SS card with new name after the ceremony, but SS person said that we can't get replacement card until we get EAD.

I am preparing AOS (I-485, I-765, I-131), all in new name. I plan on submitting next week.

Question, is it correct that we can't get new SS card without EAD?

Hmmm, my fiancee applied for her SS card yesterday. The guy at the SS office told her and my mom that after we get married we should call Department of Homeland Security to get the name changed. I wish I would have been there because thats kind of confusing to me. My moms 82 and my fiancee is good with english but the guy didnt talk very clear so I'm a bit confused on what will be coming.

Hope to see your answers and maybe get a little insight into this myself!

Yes. There have been several posts about this. Basically they wait for confirmation that you have filed all the appropriate paperwork as in their system she is currently K1, after she changes in the system to work permit authorised or something like that.

It's not a big deal because she can't work until she gets the EAD anyway and in the meantime her marriage certificate will prove her name change.

My wife had no problems with changing her name on the SS card on the basis of marriage certificate, but I've read multiple posts that at some SSA offices they gave them hard time... I guess, it entirely depends on who at SSA your talk to. Maybe try to go to another SSA office?

Hummmm, We too got my wife a SSN right after arrival in the US. We also had no issues getting my wife's card name changed right after our marriage. Her new card still has the "not authorized to work etc....." statement across the top. I can't see how an EAD card will help the SSN office decide since the EAD is only good for 1 year. I guess it depends on which office you go to. The statement on my wife's card is a moot point now since we got her green card.

Like others have said try another office, different employee at the same office or even call the SSN hot line 1-800-772-1213. Maybe they can shed some light. I got her card changed right away after marriage because we can use it as a form of ID to get a state issued ID card(florida).

Is your wife's I-94 still valid? I seem to remember the SSN office looking at it again and ours was still un-expired. Not sure if that is important......

thanks for the info..yes we will try to give them a call tomorrow via their hotline if not we will directly go to the SS office and see if they have a different lady in charge at the counter..

yes the I-94 is valid till the 18th of March...

Don't bother calling - it's a waste of time.

Suggest you go to DIFFERENT SSA office in your area.

If you don't get what you want, talk to a supervisor. Always.

she should be able to get a new card in her married name,

but maybe the SS person was helping you save a trip back, because even if she gets a new card in her married name, it would still have the "INS authorization only (something like that)" notation on the card, which means she can use the card to apply for a job only w/the EAD

and it will be removed only when she gets her GC.

if she applied for an EAD, better to wait for that and then go back to the SS office

Based on the 12/18/2009 arrival date, she will only have been here 48 days as of tomorrow, so she is still eligible to be issued an SSN card based on her K-1 status and using the Form I-94 as evidence of that status.

Now her status still needs to be verified, but if her K-1 status verifies with her maiden name, then this is acceptable to issue the card in the married name, since she has the marriage certificate as evidence of the change.

C. Procedure - Immigration Document as Evidence of Legal Name

When an alien applies for an SSN card, presume the name on the immigration document is the legal name unless the applicant presents evidence of a legal name change (e.g., marriage) that occurred after the immigration document was issued.

D. Examples of Legal Name Changes

. Name Change to a Name Different From Name on Immigration Document

Monica Mumma Stottlemyer applies for a replacement SSN card in her married name. She:

-- Completes an SS-5 showing her first name as Monica, her middle name as Mumma, and her last name as Smith;

-- Completes the other names used field, showing that name as “Monica (first name), Mumma Stottlemyer (last name);”

-- Signs the SS-5 as “Monica M. Smith;”

-- Submits a U.S. marriage document showing Monica Mumma Stottlemyer and John Smith married last week (the marriage document shows the dates of birth for Monica and John);

-- Submits a driver's license with her photograph that shows the name Monica M. Smith; and

-- Submits a DHS employment authorization card with her photograph and showing her name as “Mumma Stottlemyer, Monica.”

The U.S. marriage document supports the legal name change and is acceptable evidence of identity in both the old name and the new name because it shows biographical data (date of birth) that can be compared to the Numident record. Further, the name to be shown on the SSN card agrees with the name on the additional identity document in the new legal name (the driver's license).

SSA can process the name change request. Process the SS-5 to have the name “Monica (first name) Mumma (middle name) Smith (last name) to be shown in the card and enter “Monica (first name) Mumma Stottlemyer (compound surname) as an “other name used.” The compound surname must be entered the same way it is shown on the immigration document. Advise the NH to also contact DHS to change her surname to “Smith” with that agency.

Notice it says ADVISE number holder to report the change, not MUST before the application can be processd.

I would go back to the office and ask to speak with a manager if the person waiting on her still says she needs an EAD.
