Do you have or did theyb provide any documents that cleary state a lifetime ban? I had a friend form the PI who had something similar happen many years ago but she only received a 5 year ban (I'm not positive what her age was at the time - she is in her 30's now). I also have a friend from Taiwan who was deported because he was a college student but then quit scool and went to work but never got authorization. It was pretty tramatic but in the end he received a 5 year ban and has since been back.

I dont know all the complete details of the other cases I mentioned but I would try to confirm if they have you blacklisted as a lifetime ban or not.

Should I just give up and tell this wonderful man to forget about me and just move on with his life ? I think that he is taking it harder than I am it just breakes my heart to see him cry ( I am not really a cryer) but I did on that day and every day after that.

I'm pretty sure that several folks here told you to consult w/ an immigration attorney. It sounds unlikely that there is a fix given what you've told us, but we're not lawyers and we may not have all the pertinent facts.

As far as 'giving him up' -can you not move there?

He is willing to marry me and try to fight this case but I can't ask him to move to my country because his parents are in their 70's I wouldn't be able to live with myself (god forbid) if anything were to happen to them and he wasn't around to help and he has a really good job in th U.S. and the crime rate in my country is very high I feel so helpless and so stupid for what I did.

Now I have the man of my dreams and we can't be together.

If he has frequent contact with his elderly parents and they count on him for assistance and/or care, that is a good basis for a hardship waiver. A hardship waiver, however is not something you should attempt on your own and will require the skills of an experienced immigration attorney familiar with hardship waivers. When/if you shop for an immigration attorney, experience with hardship waivers should be a bigger concern than price.

True, but I would consult with a good attorney (not a forms filler-outer) first. Or check with your fiance's Senator's liason for immigration. Getting married has consequences and obligations whether you get a visa or not and one should be cleared before going after the other...unless he is willing and able to move to you

This means information on where they live, who cares for them, Dr.s statements, etc. It is not so simple as saying "my parents are old and need me" My mother is old but I have 7 brothers and sisters and she lives by herself in the backwoods, I would have a pretty hard time proving she "needs" me and she is in her 80's

Perhaps you did not read to the end of my post where I added:

I also do not agree with your assessment that he will have to prove that the parents depend on him for support, but would rather the experienced hardship waiter attorney be the one to formulate the exact nature and wording of the hardship.

I am also not so sure that they would have to get married before applying for the hardship waiver. Ask the attorney if it applies also to fiance(e)
