we were again denied CR-1 at Casa consulate....first interview was same CO who denied hubby's tourist visa back in june when i needed surgery....he kept asking the "other guy" CO what to do...well, this time hubby had the "other guy"....seems to me something fishy and suspicious is going on at this consulate....the CO didn't give a paper this time and only told my hubby that its the same as the first paper...which never stated what we were denied for..the CO this time told my hubby that it's being sent back for investigation...and that's all the jerk said..

anyway, my question is...

i have been told that after a second denial that you hardly ever get approved.....does anyone know if this is true or not?....and if so, what will that mean as far as this CR-1?......do we wait it out?....if denied can we refile another CR-1 or what will happen?.. :wacko: .am clueless....any advice or info would help us out lots.....thanks in advance....

I am sorry for you. See lots of denials lately out of Morrocco. I am in the same boat, my husband was denied 12/15/09 in Ghana. You will need to get an attorney now. I hear the appeal "rebuttal" process can take years.

OMG...years?......this process is really too much....so...if the consulate refuses twice and says sending back for investigation to USCIS then they will uphold the refusal?

This WAS their second interview....what a disgrace. I am so sorry for what you are going through....I don't think its true that after the second denial that its "over". I thinkk you may just need to fight longer and harder, and probably get a lawyer. But I am not an expert, I am sure someone with more expertise will advise you better....Take care and be strong!!

Timeline

The petition will head back to USCIS and they will review it. Seeing that you had 2 interviews there is little chance that they will just reaffirm it. They will review it on their own schedule , roughly first in first out , which may mean a year. During this time you should be expecting their notice of intent to deny and prepare a rebuttal. Hire a lawyer if at all possible , hire the best one you can afford. This is not the time to go for cheap. Your rebuttal is your last chance to convince them you should be allowed to be together in the US.

This will not be over quickly. You will not enjoy this.

I'm so sorry for what is going on. Is it possible for you to live there for a year or so. It would make your case stronger and at the same time, the two of you would be together. Also ... Which senator are you in contact with ?

thank you...he wants me to stay and his family as well....i'm in contact with both johnson's and thune's office...Sen. Thune's office has been a tremendous help for us..they acted quickly but unfortunately the same 2 CO's were involved in both interviews so of course one couldn't make the other look bad and approve it when the other denied...i still think something suspicious is going on in that consulate....

My wife was denied at the last interview that was in Spetember of 2006, then they sent it back to USCIS and they held it for two years, then they sent me a notice of intent to deny, and I sent them all of the eveidence I was collecting while they just sit there and do nothing. And after two months of flipping through near 500 pages of documents for evidence, they reaffirmed the petition and I am now about a week or so away from being case complete at the NVC and getting set for another interview. It will take some time and it will work out, but if the USCIS denies the petition, there is little you can do, because that means they say you lack the basic funamentals to even apply for cr-1.

I suggest you set up an appointment (or walk in) during American Citizens Hour, and ask to speak to the Head of the IV Unit. Be polite, and don't budge off, don't 'explain in detail' to any under-staffer - get the Head of the IV unit, and have that face to face talk with him.

Go over, with him, any of the irregularities of yer casefile, ask him specifically what the problem is, and tell him that you have tons of evidence that will refute any position that his underlings were trying to make. Then show the evidence to this Head of IV unit.

Failing that, I don't know what to tell you.

If uscis denies your petition after they review it and get your repsonse for notice of intent to deny, you can still reapply but will most likely get same result, but in these extreme circumstances, a good immigration lawyer will be helpful. My statement about not having the basic foundation for the petition was based on if the uscis does deny the petiion. But igree with you 1000% that the immigration process is a big mess and needs a major overhaul.
