The only way you'd really be 'burdening' your mom is if you actually thought you'd need the $$ from her. If you're pretty sure you can sustain yourselves, then really all she is doing is filling out a form to get him here.

The more binding document is the I 864 used at adjustment of status time. If she is still on the hook for that (meaning your income situation isn't improved when you file), and the two of you ever divorced & he used public assistance, the government could sue her for that $$. From where you sit, I'm sure that does not seem likely - but I feel it's best to at least inform potential joint sponsors of that responsibility.

I-134 and the I-864 are both affidavits of support, but the I-134 goes by the 100% of the poverty guidelines, and the I-864 goes by 125%. The I-134 is used at the K-1 interview, but the I-864 is used at AOS, which is why people generally always follow the guidelines for it.

Typically, yes - esp. in a consulate like London. Some others do not look favorably on it (I believe the Philippines is one) though so you can't say that is true across the board.

Edited to add: For K visa purposes, the I 864 is not used until the adjustment of status phase. It is used during the visa process for immigrant visas (CR1/IR1s).

Thanks for all your advice, i appreciate your help.

By May this year we should have around $5,000 saved. If i have that much in my savings account, would that help my case at all? With my fiances help I could have that much money saved, the only issue is I dont earn over the poverty line a year, but if I had that much saved would that change the cirumstances at all? Would they be more willingly to approve it, if I had that money saved?

It's my understanding that you must meet the 125% level, not the 100%. The 100% is mainly for members of the military. Sorry. Your income must meet the 125% and if it doesnt then your assets must meet an amount 5 times the difference.. so if you are 2,000 under the line then you must have 10,000 in assets..... Sorry not to have better news on that.

Your option is to get a second job to make up the difference until after the interview and have letters from both employers

You MUST meet the requirements for the affidavit of support. There is no "we are working on it" or we will have it soon. If you use assets they must be 5x the income required. You can also use a combination of assets and income. There is really no way around this requirement.

If you do not meet the requirements the visa will be denied.

does our co-sponsor only have to fill out the I-134? because we have sent away our I-129F 2 months ago, and we only found out about the I-134 afew days ago, does that mean we have to send the I-134, when they ask for further info on our money sittuation?

Or do we hand it in at the interview?

Good luck to you both!! I was getting a bit dizzy reading all the posts and not sure if this question was answered.

The I134 is a consulate level document, not needed for the petition. So you have time to get your sponser and information together. I believe I read above that MOM is coming through. That is really wonderful. I didnt need a sponser but my MOM has been there for me so many times in my life (and DAD too). Blessings to you all!

Certain consulates apply 125% and some apply the 100% rule to the I 134. I think London has generally gone with 125%. Even if they didn't, it's still best to 'front load' yourself and have more than they may be looking for. IMHO.

I have to say all of you are sooooooooo helpful, mini experts if you will. I now feel like I can come here, and get answers, before this site I was left with so many unanswered questions. I still am learning this whole process. But what exactly should we start working on for the interview? Any good advice for the interview?

There are two facets two the consulate/interview stage.

1. Forms, documents, medical - these are all pretty straight forward. Gather, collect and complete all the required documents that are required. Review them all and make sure everything is completed properly and completely.

2. Proof of bonifide relationship - unlike the petition which has basic requirements like proof of meeting within the past two years, the buren at the interview is to provide sufficient evidence to convince the Consular Officer that you have a true and bonifide relationship. Pictures of the two of you together at different times and in different places (with dates), pictures with family and friends, anything you have from your time/times togehter. The more visites and time together the better. (we went through a particularly difficult consulate so this was our biggest task). Engagement party proof and receipts (very big deal in Vietnam). Hotel receipts, boarding passes, passport stamps. Basically anything and everything you can compile. Email, chat logs, letters with envelopes showing postmarks.

I was very lucky and fortunate to have an employer who allowed me to take extra time, since I knew we were going through a difficult consulate I visited 4 times in '09 for a total of three months. The last being at the interview when I stayed for 6 weeks.

By no means am I saying that this is what is required for you, just sharing our information for an example.

Were making wedding plans now and then AOS - look forward to following your "visa journey". The people here are awesome and so helpful, I'm still learning!
