My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thanks for all your advice, i appreciate your help.

By May this year we should have around $5,000 saved. If i have that much in my savings account, would that help my case at all? With my fiances help I could have that much money saved, the only issue is I dont earn over the poverty line a year, but if I had that much saved would that change the cirumstances at all? Would they be more willingly to approve it, if I had that money saved?

It will not be sufficient.

If your using assets to make up the difference between income and the poverty level, you would need 3X or 5X the amount that would close the gap.

At 2009 poverty levels (making $10,000 income)

Level 3X / 5X

100% = $13710.00 / $22,850

125% = $24636.00 / $41,060

(some embassies go with the 125% level, not 100%)

What Cash Value of Assets is Needed?

To be counted, the cash value of assets must equal five times the difference between the sponsor's income and 125 percent of the poverty line for the household size.

For example, a petitioner/sponsor with a household size of four and an income of $18,000 would need assets equal to five times the difference between his/her income and the income required for a family of four at the current federal poverty guidelines level. He/she would also need to show evidence of mortgages, liens, and liabilities against the assets.

The cash value of assets required is different for these sponsors:

Sponsors of immediate relative spouses and children of U.S. citizens must only show assets in the amount of three times the difference between the poverty guideline and actual household income.

Here's what you do to determine how much your savings will help your case.

1.25*Poverty_Line - Your_Income = Income_Shortfall

Income_Shortfall * 5 = Savings Required (3 for consulate, but look ahead to AOS!!)

So, if you make $10k and the 125% poverty line is 19k, you need to make up 4k in short fall. You need to have assets equal to $20k by the time you apply for AOS, shortly after he enters the country, or $12k to get the visa.

In London, the assets can be a combination of yours and his.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

ok lets say they wink an eye and let you pass with just your savings ,

just so you can be together ( wich wont happen but just to show you reality )

ok like i said the wink happens and your fiance is aproved the K1

( reguardless of all the costs you will have , with the medical exam, police cert visa fees , plain ticket to get your fiance here )

, do you know you have to get married within 90 days of his arrival ,

then file for AOS wich is another 1010.0 $

and by that time they defenatly require the afidavit of support for the AOS and if you cant find a cosponsor then ,

your fiance will have a high chance of getting his green card application denied and he will have to return to his country,

so like I said before you should read all the guides every little small print too

Your 5k wouldn't help you in the slightest. You have to prove 3x or 5x if you're using assets.

It's either best to get a cosponsor or wait until you're in a better financial situation.

But DO be aware that this process costs A LOT of money, and that you wont get a refund for your $455 if you cancel.

This is why I'd seriously step up the search for a joint sponsor as soon as possible.

I am having major subtraction issues lately...but the conclusion is the same. Even if you could save all of your gross income, you wouldn't make up the income shortfall in the appropriate time frame. That leaves options one and two.

1. Get a cosponsor

2. Get a better job/more hours/a second job.

i learned today that there's no way for my k-1 visa to go through now. what a great feeling.

You wont even TRY to get a consponsor? You're just going to give up???

Most people here would go through family members, one by one until they could find someone to cosponsor. It doesn't run your credit, all you need is a signature, an employer letter, some pay stubs and maybe a w-2. It's not the crisis situation that everyone imagines it is.

Agreed. And it doesn't even have to be a family member - just a US citizen or LPR who are willing to agree to it.

Or there is the option of a second job as Nik+Heather has mentioned several times.

Beyond that, I'm sorry that you didn't research this as you should have before filing - but it is what it is. All you can do now is try to overcome the obstacle.

We were both just so overly excited, that I didn't go through everything very meticulously, but I always had a very ominous feeling that it wouldn't get approved. He's my whole life, and I want to start our lives together, I just hit a wall.

We did the research, tried to find info on the money sittuation, called people. they didnt give a solid answer. But thanks to you guys we now have a more clear view on what to do. I'm determined to overcome this obstacle.

Thanks. What doesn't make sense is that I don't make enough money, but when he would move over here we would both be working, and with us both working here in the US we would have enough money over the poverty line, no one in my family has ever been a public charge. Do they not take anything like this into consideration? Do they just look at how much you make, and deny you if its not adequate?

Also, in order to work in the US after moving here and marrying you, you would have to file for Adjustment of Status and he would have to receive an Employment Authorization card.

The best plan is to find a sponsor or a job that pays enough to bring you over the poverty level.

at times it may seems like no one will be willing to help but if you try and ask people you will be amazed that you can always get a co-sponsor. if u really want him here you will try more, no amount of savings and even a second job can help you at this time, your best bet is a co-sponsor which is relatively easy. a coworker at target who is single without any dependant only need to make $18,212 (2009 poverty guideline) it will just be the co-sponsor ad your fiancee as the family members and you will be fine. Eve if you get an additional job now I do not think the embassy will reckon with a new job like that, seriously look at the poverty guideline it isn't too much that you cannot get a co-sponsor.

Sounds like you did not research this process enough before starting it. everyone feels for you, but no one is going to lie to you just to make you feel better. if you could just find another part time or full time job, and get a letter from that new job stating how much you make weekly. add that to your income you have already and you should be good to go.

or a co sponsor.
