Hello everyone. I have been stressed out beyond belief concerning this K-1 visa. I have huge questions, and I came here to see if any of you could give me some answers. I sent off the I-129 F out at the end of November 2009. I have not heard anything back yet, I used this site as help to make sure we we're filling out all the documents correctly. So far I have not heard back from them, it's been 2 months. I just turned 20, and my fiance is 19 and lives in London. We both work, I don't make much, I work at Target and I earn about $10,000 a year. He works at a hotel in the UK and makes a lot better money than me. What we are so concerned about is the affidavit of support, they want you to make 100% of the poverty line, and $10,000 is not enough. So I feel that it will be denied, and it's killing me thinking that I cannot be with the person I love with all my heart. We are both saving, he has around $2,000 saved, but I know his earnings have no effect on the I-134. if he went to the interview and showed them what we've both saved, would they accept that? Or would they just deny the whole visa? I have no clue what to do, I feel so depressed. I would do anything to have him here, it just feels that with our situation it will be denied. does anyone know if we have a chance or not on this visa?

Did you at least get the NOA1 (I-797C Receipt Notice) after you filed? You should have received one within 30 days of filing the application.

You can get a co-sponsor for the I-134 Affidavit of Support - you may also use assets!

Not having adequate income will not usually be a problem if you have a co-sponsor, according to experiences posted on the newsgroup, as long as the co-sponsor has adequate income/assets. Be aware that the co-sponsor must have enough income/assets for both your fiance, any fiance children that will be immigrating, and his/her own household.

Welcome to the waiting game! We started our process in August and it has been helpful to spend the downtime researching and working on the next step. As previous posts have stated you can get a USC co-sponsor to help pass the affadavit of financial support. Some people use parents, grand-parents, siblings, god-parents, etc...can you think of anyone at all that could help you out in this area? You could also look at a second job to help boost your income level...

What doesn't make sense is that I don't make enough money, but when he would move over here we would both be working, and with us both working here in the US we would have enough money over the poverty line, no one in my family has ever been a public charge. Do they not take anything like this into consideration? Do they just look at how much you make, and deny you if its not adequate?

They do not take 'future earnings' into account. How would they gauge such a thing? Nor do they care if your family members have become public charges or not - that would have no bearing on you whatsoever.

All they want to make sure of is that the alien will not become a public charge when he/she arrives on US soil. The only way to do that is current earnings of either the alien (alien's can self sponsor. See http://london.usembassy.gov/cons_new/visa/iv/faffidavit.html -- though I don't know your fiance's situation enough to know if this would be a viable option), USC or a joint sponsor.

As others have said, if you have concerns that what you or your fiance make will not be adequate, line up a joint sponsor in advance of the consular interview.

If you don't do that, then yes, the visa application can be denied.

sorry to say but

uscis doesnt care if any family member has ever been a public charge ,

since its not your family who would like to get married to your fiance ,

they do care on how much income you have and if you would be able to suport your fiance ,

if you dont have enough income they provide the option of having a co sponsor ,

if you cant find a cosponsor my advise is try to find another job ,

because the reality is even if your fiance gets aproved he would still not be aloud to work untill he gets his work authorization card or green card .

and this is a another process you would have to file for wich is called adjust of status wich has to be done after you guys got married ,

I dont like to tell you all the reality stuff you will encounter but my advise is do alot of homework on what you guys will need,

read the step by step guide for k1 also for AOS because you will probly need more then 2,000 for the whole process till green card is aproved ,

am not saying this to scare you but am saying it so you will be prepared for whats down the road ,

like I said please read the guides and you will understand more on the process

and remember nothing is impossible if you have patiance and determination

How does self sponsoring work? If you put his money and my money together it should be enough. But they don't do that, they only look at my earnings. OMG.

Yep.

London's primary focus is on the financials. In this process, you have to forget about what's "fair" and focus on what's "required".

You are required to prove that you or a co-sponsor can sufficiently support the person who you are petitioning.

Make one of the following options work:

- Find a cosponsor who will agree to sign the forms. This person should be in it for the long haul, as you'll want them for AOS as well - that's a 10 year commitment.

- Find a second or a better job which will enable you to meet the income requirements. By my round calculations, you either aren't being paid minimum wage, or you aren't working full time.

- Save 5x the poverty level in liquid assets (your primary residence, or your only car DO NOT COUNT). I know that 3x is for the consulate, but you need to look ahead to AOS.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

I am aware of all of that, but by the time this visa is done, We would have more than 2,000 dollars. the thing that worries me is i am not above the poverty line, and i cant get a co-sponsor so i am left in limbo. feeling helpless

$2000 is only half of what even your adjustment of status will cost ($1010). And remember too that you will have to prove support again at the adjustment of status phase. If you cannot either increase your income, line up a cosponsor, or your fiance can't self sponsor - I'm not sure what other choice you have.

Perhaps it may have been better to file the I 129f once you had this situation a little better in hand. I know you can't 'unring' that bell now, but this is one of the many things a couple has to take into consideration when planning for a visa to the US.

What about your parents? Aunts, uncles, brothers, sisters?

USCIS isn't going to care whether or not you can save up more money before this is done. They want to know things NOW. They don't care about his income, either. They want to know about yours since you are basically paying his way until he gets his work authorization. So in your thoughts, leave everyone else out of the equation except for YOU. You already know you don't make enough, and unless you can make up for it in assests, you will HAVE to find a cosponsor. Otherwise, I'm sorry to say, but no dice. It's a very cruel thing, but USCIS doesn't care if he's your one true love, they're all about the hard facts of the situation, and you can't live on love.

I made $50 under what I would need to be 125% over the poverty line. That's the most frustrating thing to me in the world. So I had to ask my mom, no big deal. You should try and find someone to do the same for you.

Thanks for all your advice, i appreciate your help.

By May this year we should have around $5,000 saved. If i have that much in my savings account, would that help my case at all? With my fiances help I could have that much money saved, the only issue is I dont earn over the poverty line a year, but if I had that much saved would that change the cirumstances at all? Would they be more willingly to approve it, if I had that money saved?
