Hey Guys!

Just wondering if anyone has or knows where I can find an example of an affidavit for me to use towards proving my marriage as bonafide? (Filing for CR-1)

also do these affidavits have to be notarized? or just signed by the person? Also should they be typed or handwritten?

I'm trying to get this first package off to start this process, we are taking longer than necessary! I want to start my own timeline too :(

Hmm. Are you referring to the "Affidavit of Support", or a different kind of affidavit? If it's the former, then it's a form that your spouse needs to fill out and sign, and is available via the Guides link at the very top of this page. It will not need to be notarized.

Otherwise, I'm not sure what other affidavit you are referring to...there should just be the one required by the government.

K-1's have to sign affidavits expressing their intent to marry, but there isn't really anything similar that CR-1's are required to create and sign. Are you talking about signed affidavits from family members and friends that attest to the validity of your marriage?

If you go to "example forms" at the top and look under "Lifting of Conditions (I-751) Related Forms" they have an example affidavit for friends and family members. Its a pretty generic format that could work for any visa.

I'm not really sure how many people actually do this and if it is very important or effective. I imagine some CR-1 fillers will come in with their advice.

First, you don't "prove" your marriage is bona fide. You can show evidence your relationship is bona fide. Newlyweds usually do this primarily at the interview with evidence of communication and visits and a good "interview". When reading the I-130 instructions, you would be wise to consider anything listed after the words, "In addition to the required...." as "not required".

If you insist on providing affidavits, maybe something along the lines of "We were at the reception and they seemed really eager to get out of there and start the honeymoon." or "We stayed in the adjoining hotel room and it seemed like a bona fide relationship from what we could hear through the wall." would be good examples. What else are people who wouldn't lie for you know about your relationship know anyway.

We did submit three affidavits in addition to the required marriage license. Whether or not they were necessary who knows. We did not send any other evidence (photos, emails etc.); those were saved for the interview.

Thanks everyone. I am referring to the evidence of a bonafide marriage. I was going off of the I-130 checklist on the site. According to the list it says need:

1. Documentation showing joint ownership or property; or

2. A lease showing joint tenancy of a common residence; or

3. Documentation showing co-mingling of financialresources; or

4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or

5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or

6. Any other relevant documentation to establish that thereis an ongoing marital union.

So is it not necessary to send this off in the first package? Do i save these things for the interview only? Now I'm confused.

There's many things on that list of 6 types o stuff that you may not have, if you are a newleywed..

But - affadavits from people can be useful.

If you check the detailed instructions on that - yikes - they want lots of information from 'that ' person writing an affadavit, yes?

Off the top of my head its:

Name, ID # , address, telephone #, then in the body of the letter - how that person knows YOU TWO, and how that person knows the two of you are married.

IMO, ya, an affadavit should be notarized. Most banks do that , for free.

As for 'necessary in first package' - wei - send off as much as you have, as much as you can, for the first submittal.

Remember - the ConOff at the Embassy/Consulate will Review this information, prior to interview day, and on interview day - so the more you can 'front-load' , the better.

If you did not send off the info - well, you MIGHT have opportunity on Interview Day - MAYBE - you can certainly bring it, but the ConOff won't have much time to review it.

I'm with Darnell on this one. We actually included affidavits 3 people who know me and 3 people from my husband. We went through Casablanca which is not known to be easy. We front loaded the application and then brought the new information with us to the consulate.

It really does seem to be consulate specific.

As I noted above I only submitted 3 affidavits. I did not discover VJ until I had submitted my I-130 so I did not even consider sending photos or other evidence with the initial application. I would never suggest it was not necessary and we all have to make our own decisions as how to proceed.

However, from reading many of the reviews from Montreal very few of us were asked for any evidence even at the interview stage. Even so I went prepared with ten years' worth of telephone bills, emails, photos etc. Better safe than sorry.

I found that regardless of what I did, I worried throughout the entire process, constantly second guessing myself. It was only once I had cleared the POE that I finally breathed a sigh of relief!

If you read the instructions carefully, you'll see that the entire list you quoted appears after the words "In addition to the required...." and then later says "one or more..."

Usually newlyweds concentrate on number 6 and do so with some photographs and perhaps some evidence of time spent together and/or communication evidence.
