Timeline

hi, hi all im new hope im doing this area!!! my question is...im married to a u.s citizen im in u.k waiting on paperwork to go through etc..im in a financial mess which im trying to sort out will this go against me? or is that if i go bankrupt? am i allowed to or not as dont want to make things worse! (if thats at all possible right now) it's hard enough with husband on other side of world and trying to travel backwards and forwards with children never mind now being made redundant and in a mess..feeling desperate xxx

Neither debt or bankruptcy is an issue in the immigration process unless you have an IRS lien. You'll need to qualify based on current income.

Facts are cheap...knowing how to use them is precious...

really????/ phew so if they think best way forward is for me to go bankrupt im ok???..... my husband is fine over there but all this travelling running 2 homes and previous money worries all caught up with me x

I think they really only look at the US citizen's ability to support the foreign spouse - as long as your husband meets the required income level for the Affidavit of Support, you'll be fine ^_^

oh thank u both...im going out of my mind and only came back from him 3 weeks ago and hate not knowing when will see him again our application only just going in as we speak we were married in sept but money so tight..yes he can support us once there he trying to do our house right now. i just want to get home to him its like living 2 lives x i need a job!! any advice is great thank u

*HUGS* Relax! Things will work out...

Just make sure you have all the documents you need.

For the Affidavit of Support, you can also include your husband's most recent pay stubs, a letter from his employer, etc.

You can also use assets - bank statements, car titles (if you at least 2 cars), property (less mortgage owed), etc.

And if needed, you can always get a co-sponsor (if income level doesn't meet the minimum requirements).

Don't worry, love will prevail!

I'm now confused about who is the US Citizen in this case. Is it the husband or wife? If the foreign wife is doing bankruptcy, that's no problem as long as it doesn't impact her passport. For the US Citizen, it won't matter unless there's an IRS lien.

sorry im the wife and considering the idea of going bankrupt...is there no way i can join my husband with my daughter in the us and file there???? or is that not at all possible?

Entering as a non-immigrant with intent to immigrate is visa fraud. You'll need the appropriate spouse visa.
