hello guys, Im a green card holder. and just completed 2 yrs since i got my GC. i have just filled I-751, im still married to my wife we live together and everything. during this 2 yrs. i have been to Brazil around 6 times. business trips and 2 vacations. how soon can i apply for my citizenship? (ofcourse if everything goes right with my i-751). thanks.

On the easy way so u can understand me .. Look at ur current Green Card MM/DD/YY when it was issued, from there count 3 years minus 3 months. So, even if u going to apply for ur I-751 that time counting too

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

understood, does the time that i have been out of the country affects on anything? i.e: I was in brazil for a month one time. is it 3 yrs of green card? or 3 yrs of being here in the USA?

you need to have been physically present in the US for 18 months for the 3 year period prior to application. so just count the total number of days you were out of the country once you get to 3 years as a permanent resident (the date of your green card is generally the basis). as stated above, you can file 90 days prior to the 3 year permanent residency date.

It is not 3 months, it is minus 90 days which is a difference. Sending it in exactly 3 months will cause problems and having a delay as it's rejected and returned because it doesn't meet the requirements. Be safe most people send it around minus 80-85th day.

INS is very pickey on the exact timing of this so rememeber to actually count the days not months as each month does not always have the same number of days...

Part & of the N-400 only asks about your trips, not the reason why, if your employer makes you take those trips so you can keep your job, would list that reason on a separate sheet of paper. With many US corporations getting their manufacturing done abroad, my son was finding he was spending more time in China than here. But he doesn't have that problem since he is a natural born USC. But sure would if applying for USC. He recently found another job so he can spend more time with his family.

While the N-400 instructions state it takes an average of four hours to complete the N-form, feel they are making minor assumptions, like you have all of your evidence and dates in front of you and are an expert with the M-476 manual and N-400 instructions. With a year off, now is a good time to start, may have to make adjustments in your financial married life to show just about everything is being shared and looking up those dates. That may take slightly longer than four hours. Also become familiar with the civics test.

If just applying for the I-751, that is your major area of concern, it's up to you to keep yourself legal, don't expect any help from the USCIS. See they still have extensive delays and still are real picking if you send your application in just 24 hours early, even though they take months or years to process it.
