Passport or Birth Certificate

Guys, filing AOS for my wife and saw that we can either send in her translated birth certificate or her passport. Her passport is in three languages to include English so we're thinking of just sending that in since her birth certificate is in another language. Any thoughts about that?

Kind of confused even after reading the AOS Guide for those foreign spouses that are already in the US. Do we send ALL of the documents as identified in the guide or just one set of the documents as listed under the title, "Assembling the I-130 Package"? Or, do we also send the documents listed under "Assembling the I-485 Package"?

Since we're already married shouldn't we enter her current name into the documents vice her former maiden name?

You are filing an I-130 AND an I-485.... you need provide the required documents for BOTH

I second the motion. :star: For AOS, send both her birth certificate and passport copies.

What visa did she use in coming here?

If she has changed her name on your marriage certificate, use that new name in filling out forms for the AOS.

You need to send the birth certificate, translated by a certified translator. However I have heard that some people send it translated by themselves and it doesn't cause a problem. I spent $60 to get mine translated, at least I know that it will not get rejected. I used to have translated copy from when I came to USA as a student but it seemed to have disappeared into thin air :)

You have to send both copies of: passport and BC (with translation)

ask someone for translation who speak both English and native language of Your wife

that don't have to be "certified translator", but this person have to write that phrase:

Certification by Translator

I ... do hereby certify that the above is true and exact translation of the whole original document in the ..... language, as it was presented to me. I am familiar with both ... and English languages and have made this translation to the best of my knowledge, ability and belief.

the instructions state that it has to be certified translation. I tried doing what you said (which also has to be notarized if you go this way) and the notaries said that he can't notarize it if I am not certified. However it is your choice, and like I said earlier people do this and it is accepted, and probably m_ru went that way and it worked for them ;)

1) You will have to send in copies of the passport as well as the original birth certificate and the translation of it. I got my international birth certificate from the city I was born in at no cost via mail. You may also have the original translated by a certified translator, your choice.

2) Yes, you have to send in the accompanying paperwork/evidence for both the I-130 and I-485, since you are filing both. Even though you will file both at the same time, USCIS takes it apart and handles each separate, therefore you need the accompanying papers for both.

3) If your wife would like to use her married name from now on and have it displayed on her greencard, you should fill out the forms with exactly that name. I have done it and had no problems.

certified translator means this person

certified that translation is correct and he/she knows both languages

that mean You don't have to hire professional translator

but he/she should be 3parties (not you or your wife)

and You don't have to notarized that
