Question related to 'physical meeting' requirement

Dear all,

I am planning to file petition for a K1 visa on behalf of my boyfriend. I am a US Citizen and he is a UK citizen, and we are family friends. He has been to the States a couple of times last year (2009), while he was going through this divorce. His divorce settlement was finally issued only last month (Jan 2010). When filing for K1 visa, it is ok if I show proof of our last visit (in Dec 2009) while he was technically NOT divorced, i.e. not eligible? Please let me know if any of you had a similar experience or have some background related to this situation. Your feedback is much appreciated.

The short answer is yes you can and I personally would. Not having a final divorce when you guys last met doesn't make him indelible. Not having a final divorce by the time you send in the petition will though.

Please let me know if any of you had a similar experience or have some background related to this situation. Your feedback is much appreciated.

There are folks here on VJ (and everywhere I'm sure) that had met in person while one or the other (or both) were technically still married (i.e., no final divorce decree yet) and filed shortly after they became final and submitted evidence that kind of shows that but were successful like any other couple.
