Hi,

I have recieved an RFE for two pieces of evidence for a family based (parents) AOS petition. RFE requests:

X Submit a copy of the applicant's birth certificate issued by the appropriate civil authority. If the document is in a language other than English, you must submit a copy of the foriegn language document and an English translation.

If the birth certificate is not available, per Title 8 Code of Federal Regulations Section 103.2 ( B )( 2 )( ii ), you must submit "an original written statement on government letterhead establishing this from the relevant government or other authority. The statement must indicate the reason the record does not exist, and indicate whether similar records for the time and place are available" If your birth certificate is not available, please submit acceptable secondary evidence including but not limited to church or school records listing your parents' names and your date of birth, hospital records of your birth, etc.

X Submit all supporting tax documentation (W-2s, 1099s, etc) submitted to the Internal Revenue Service (IRS) from the petitioner/sponsor on Form I-864, Affidavit of Support, for the most recent tax year.

Couple of questions:

on the first item, would it be sufficient to submit:

Birth certificate (it does not have my name on it)

Affidavit from parents about parentage and date of birth

Marks transcripts (high school / college) with name, DOB

Parents' marriage certificate

and on the second,

- Transcripts obtained from IRS for the 2008 submission which was the most recent year (2009 is not yet submitted - should this be submitted ?)

- W2s, 1099

- any other docs ?

any information on either / both would be greatly appreciated. Thanks!!

Couple of questions:

on the first item, would it be sufficient to submit:

Birth certificate (it does not have my name on it) - No. A true birth certificate of COURSE has the name of the person who was born. They won't accept it otherwise. What country are you from? If it's a country that doesn't have names (which i highly doubt otherwise how is there proof who the certificate is for?) then there may be something you can obtain that says that (the part i bolded above sets the requirements) and THEN I would make an INFOPASS appointment to discuss your options. A birth certificate has both parents names, and the child's name.

Affidavit from parents about parentage and date of birth doubtful it would do anything. Anyone can sign an affidavit. it's not government proof

Marks transcripts (high school / college) with name, DOB see the part I underlined and italisied above. It sets the other requirements if going by this type of record

Parents' marriage certificate doesn't answer the BIRTH question

and on the second,

- Transcripts obtained from IRS for the 2008 submission which was the most recent year (2009 is not yet submitted - should this be submitted ?) 2008 is fine for now.

- W2s, 1099 Not needed if you do the IRS transcript but it can't hurt.

- any other docs ?

any information on either / both would be greatly appreciated. Thanks!!
