Hi,

I am a K-1 visa holder, about to adjust my status, and have only happened across this part in the form, I have the DS-3025 (the vaccination document worksheet) which was given to me when i had my medical in London.. all the vaccinations have been checked under the completed series, or not age appropriate... except this Varicella one. Which say VH beside it, and then at the bottom in the results section of the form they have checked the box vaccine history incomplete. They have also checked - Applicant may be eligible for blanket waivers because vaccinations not medically appropriate.

After reading this post it seems i need to get this transcribed onto form I-693 by a civil surgeon here in the US, is this correct? when i call the civil surgeons is this all i ask for?? Do i need to have this Varicella vaccine? Surely I don't need to have another full medical??

Since you had chicken pox, you don't need the varicella vaccine. Call a CS near you and ask for the person who normally works with immigration paperwork (my CS's office had one staff who had no idea about immi paperwork and one who dealt with it often). Tell that person you have your vaccination record and you need it transcribed onto an i-693. There should be a nominal charge for this service. Don't buy into some of them trying to talk you into a full medical.

One I talked to tried to tell me they were the "only cs in town who knows how to fill out the paperwork correctly" and the minimum fee would be $75 but could be $250.

Another said, "I think they have to have a full medical in the US". Wrong.

Our final cost @ a CS who knew what he was doing = free, but some pay $30 to $50.

Some people have successfully submitted their AOS with just the DS-3025 (of course, if everything was done correctly to begin with, USCIS should already have the original DS-3025 when they got your K1-visa packet). Others have received the RFE for it. I'd be inclined to think that you should submit the I-693 just to be on the safe side.

You don't NEED to have it transcribed but some people HAVE had RFE's by just submitting the 3025. If you want to submit the 3025 and wait and see what happens, no it shouldn't slow down your EAD or AP, but it will the AOS.

Your sheet sounds the same as mine. VH means "varicella history" so you should automatically be immune (some unlucky people actually do get it more than once!). You shouldn't need the shot for it.

Some of the requirements have changed and while I am 80% sure my sheet is complete (I know I didn't need shots when i got here, but I'm not sure what the changes mean for me) I don't want to run the risk of it slowing me down. Normally it wouldn't bother me but if I can avoid an RFE I would like to. Plus the place near me only charges $50 and that's not too bad in the grand scheme. Apparently the RFE can slow you down by 30-60 days! and I would like my GC ASAP so I don't have to keep thinking about it.

Really? I have seen postings which say the opposite thing. Is there an official source for the bolded statement? I am especially curious, because we took the approval of the EAD to be confirmation that our RFE was truly dead.

We submitted just the DS3025 which was exactly as your is described. It was after the new changes of summer 2008 adding the TB skin test component and some new vaccinations. Everybody was in a flurry about the TB testing which was actually part of the medical tests and not on the immunization sheet for Civil Surgeons. Skin tests were not given by Panel Physicians abroad...only chest x-rays. We researched and wrote letters and tried to figure it out. The TB skin test turned out to be a non-issue and the panic died down among K visa holders after a great number of us didn't do the transcription thing with a civil surgeon and didn't get a TB skin test.

Now things are in another flurry because of RFEs that seemed to start with November filers. There is much speculation as to why those were received, but no clear cut evidence of just what USCIS is wanting. They have written many new pages of Q&A, but it's addressed to many groups of AOS applicants and it's hard to know exactly what they want from a K visa holder who had a medical exam. And the people on VJ don't always say exactly, word for word, what their RFE stated. And they don't tell if they actually had all the immunizations or just thought they did since the visa was granted to them. A visa is given whether you get shots or not. Maybe some of them had a Class A or B condition that needed further documentation by a CS of a follow up in the US. It's really hard to know the particulars of each half-reported RFE on VJ. So the speculation begins....you didn't get the whole series or shots, they don't trust foreign medicals anymore, you have to get your records transcribed no matter what, you have to do a new medical if you get an RFE....you've read them, I'm sure.

My latest thought is leaning toward the TB testing component. There's information about adding a screening other than the TB skin test called the IGRA. They talk about medicals done after Nov. 1 and before Dec. 31, 2009 and specifics on how to fill out and what form of I-693 to use. Medicals (or transcriptions?) done after Jan.1,2010 must use the new 10/14/09 version of I-693. (It includes a place to record the IGRA blood test for TB.) Of course this is very general talk aimed at the majority of AOS applicants who do get the complete medical exam by a CS. This particular item is interesting and open to interpretation of how it applies to a K1:

Q. Will USCIS accept a Form I-693 if the civil surgeon performed a chest x-ray without the initial TB test (either TST or IGRA)?

A. No. USCIS will not accept a Form I-693 if the civil surgeon performed a chest x-ray without the initial TB screening test (either TST or IGRA) and if the civil surgeon failed to provide a valid exception to the TST or IGRA initial screening requirement.

So is the bloke at USCIS who just had to study all these new changes (including dropping HPV and zoster requirements and dropping HIV testing) as confused as we are? Does he look for TB testing since the new document changes are because of it, and does he reject anything that doesn't have the TB skin test or IGRA sections filled in? If you didn't have a transcription at the CS, would the date of your original medical get you by? Does having a transcription after Nov. 1 put you into a new requirement category just by seeing a CS rather than relying on your old medical?

I'm speculating like all the rest, but I'm not saying YOU MUST do this or that. I'm only raising questions for debate.

I came on a K-1 Visa and only had the chest X-ray done by Panel Physicians. We submitted the new version of I-693 with the transcribed vaccine portion. The only thing that the CS mentioned was the extra Td/Tdp vaccine that I had to get, and he sounded like he knew what he was talking about. So...with that said, I'm hoping there will be no RFE's regarding I-693.
