To make a long story short:

I married an illegal immigrant in October 2004, and I turned into a naturalized citizen in August 2005, but we never submitted any paperwork for her because she entered the US illegally. Our relationship started going sour in 2006, and on December 31, 2006 I traveled to Colombia to visit my family, and ended up meeting a woman. We went out on a few dates and I liked her a lot. When I returned to the US, after a few months my wife and I decided to get a separation. We were separated for a few months, during which I kept talking to the woman in Colombia. In April 2008, our divorce was finalized, and in June 2008 I traveled to Colombia to get married with my new girlfriend. I began the CR1 process for my new wife and her appointment was approved for January 28, 2010 (just a few days ago). During her interview she had all the documentation and proof needed to show that we had a long lasting relationship, and not a fake one. Unfortunately, the consul asked her about my previous marriage, my affair with her, and why I was unfaithful to my previous wife. She was unable to provide the answers to their questions so her visa was refused under section 221(g) and they asked that we reschedule our appointment, and it was recommended that I attend this appointment.

Now here come my questions: Will my wife's visa be denied because I was married in the past, and I was unfaithful to my ex-wife? Also, is it possible that maybe they just want to know what happened to my ex-wife and want to know if she is still illegally in the country? When you call the Visa Information Center can you select your new appointment date, or do they give you the date?

Any and all help will be greatly appreciated.

Hi .. I hope it may help. We have not Received the visa yet, but they told us we are approved and that my husband's case is just pending administrative processing in Islamabad, Pakistan. I married a man back in 2002 who was on an expired student visa. He had been illegal for 5 yrs prior to my marrying him, which i did not know. We only applied for his I-130 because he was working under-the-table and not paying taxes, which my parents were unhappy about. So we filed. We were married 7 yrs and had a daughter together. It wasn;'t until the baby was born that I realized I was unhappy. I met a man through a friend of mine over the phone and at first it wasn't even about friendship, he was just an acquaintance, "hi" "Bye" kinda thing. Then we realized we had a lot in common, we started talking more often on the phone and internet. I realized that just by his personallity that I loved him, and I barely knew what he looked like. So, upon my separation from my hubby, I travelled with my daughter to Pakistan to meet him. We were together there for a little over 3 months, and then I had to come back to finalize my divorce and hand over custody of my daughter to my ex. My ex naturalized shortly after, and I returned to Pakistan, got married, and filed for I-130 and K3 for my husband. We had the interview for K3 on Nov 2, and are still waiting for our visa. They said it was approved and everytime we call Dept Of State they say it is just fine and only undergoing processing. So. my words to you are good luck and I dont think your divorce will affect your wife's visa as long as the divorce is clear and final and there is no question about it. Being unfaithful to your spouse is a moral sin, not illegal, or else there would be a lot of people in jail for cheating. It is a civil matter which is grounds for divorce, but the reason for the divorce shouldn't affect your chances of visa. I think they were asking her just to make sure she knows what she is getting into. There was a man at the embassy in Islamabad that was marrying a girl and they asked him if his wife was a good cook. And he said he didn't know. then they told him "If you are marrying her, don't you think you should know if she is a good cook or not?". So.. good luck to you and take care. If you still have concerns, contact your local Senator's office. They usually have people who handle immigration cases, you can give them your case number and ask them whatever questions you want. They have been doing it for years and have seen many different circumstances. Don't be afraid to ask.

Thank you both for your responses. I definitely feel better about having to request a second interview, and to have to go to Colombia. I hope all your processes go well as well.

Well first of all, the fact that you were married before shouldn't affect your present relationship, meaning getting the visa, but it's definetely important that your present wife knows everything about you and your past relationship, by requesting a second interview and the need for you to be there is crucial since they will be asking you questions regarding the past and at the same time they will try to make your wife realize that you cheated on your ex before and with all the respect they may try to tell her that you can cheat again, now is really up to you to clear the air and explain the situation how everything happened, your wife must know the answers too, at the end like the person before me said, cheating is a moral thing and it's definetely grounds for separation and divoprce, but i'm sure that providing them with detailed explanation and providing enough relationship evidence you will be able to pass the hurdle and bring your wife with to the states.............. about making the call, you can do it form here (USA) they will charge your debit /credit card $15 or so, and they will give you a choice of two dates, within two weeks of your call.
