Hi, I got my greencard through my husband in Feb 2009. I have almost a year to file for removing conditions (form I 751). However, I was wondering if I can file now. Is there anything that says that one can not file before certain time?

If removing conditions based on your ongoing marriage you can file no earlier than 90 days prior to your green card expiration.

If you are divorced or divorcing you can submit the I-751 earlier.

Hi, I got my greencard through my husband in Feb 2009. I have almost a year to file for removing conditions (form I 751). However, I was wondering if I can file now. Is there anything that says that one can not file before certain time?

Yeah. The instructions that came with the card. You have to file within 90 days before your card expires. You got your card in 02-2009 so you will be eligible to file around Nov 2010. Do not under any circunstance file before the 90 days countdown. If you do it will be rejected and USCIS does not give refunds.

within 90 days before your second residence anniversary - no exceptions if still married.

However, if you do file earlier than 90 days, USCIS will return your package including the payment - they won't cash it!

This form must be filed during the ninety (90) days immediately prior to the expiration of your conditional resident status.
