I have gotten myself into a bit of a mess.

I arrived in the UK to visit my fiancee as I was pregnant at the time with the intention of going back. Anyway to cut a long story short I ended up staying in the Uk and my fiance got me put on private medical care so I could have our son in the UK.

He is currently waiting for his NOA2 to come through, ( will try and get the details of him to fill in the timeline soon) and we are then moving to america.

Anyway I have now overstayed my visa for the UK and because we are not married the US consulate says I cant register him here as I dont have a marriage certificate. Obviously my son is a USC by birth and also a UKC, he also has a UK passport and birth certificate.

Anyway I am getting worried about when we go through immigration at the US POE. I will be going through with my US passport, my fiancee will be going through with a (hopefully) a K-1 visa and my son will have to travel under the VWP.

Is there a chance that they might not let my son into the country, or if I take enough evidence that he is US citizen will they mind.

wrong toatly wrong usa consulate cant deny the passport of your baby at all if you are a usa citizen then there is no way they can deny. it doesnt matter if you are married or not as i told in the topic about my example you can I'm in UK, pregnant but fiance is a permanent resident. I want to have my child in USA. What are my options

Meeting Online: Yahoo chartroom Aug 2001.

Direct meeting & marriage: Dec 2003 USA, NY

I-130 petition in DCFR Tokyo: March 14th 2004. Case reffered to DHS USCIS

Four visits to japan in 2004: Oct 2004, wife got pragnant.

Wife/Fiance left USA and moved into Japan: Feb 5th 2005.

Baby Born: June 24th 2005(Japan)

I-130 denied: July 17 2005(Divorce was declared not valid)

Refiling Divorce: oJuly 17th 2005 NY State.

Divorce granted: Nov 17th 2005

K-1 application: Mar 1st 2006

Approval: May 23rd 2006

US consulate RFE: June 15th 2006

FRE sent (Original passports, birth certificate, all origional docs): July 10th 2006

Medical: Oct 11th 2006.

Interview: Nov 10th 2006(expected)

no they dont have anything to do with your visa of UK. its the uk immigration problem now it happened to me too, we had baby so when we went for the usa passport they said the marriage is legal bcz my wife divorce is not valid so it means we were not legaly married. but us embassy took a written statment from about me being a legal father. and they issued my daughter the usa passport. since you are a usa citizen so they cant deny your baby passport

CONGRAJULATION First to both of u becoming a parent of a beautiful baby boy as fas what status of ur son concerned in usa that i dont know but as u said ur son had british passport and his father name must be mentioned on the UK passport so when ur fiance applied for k1 he can mentioned ur son name also but as u r a us citizen i dont think so ur son had any problem entering the state as the baby mostly stayed with mother and he is just infant so i dont think u had any problem taking back to state when u go but incase if it do then ur fiance had to mention the son also in K1. Wish u best of luck for ur future life
