Timeline

I filed single.... due to I recieved a larger return... I would think that if you were not in the US in 2009, that she would have two options... 1.) Married filing seperately or 2.) single.... this is the advice that H&R Block gave me when I filed my taxes last week

Yes you can file taxes as long as you were married in the year that your filing for. I am the usc and was married in 2007, u need a ITIN number for your OP which you can get through the IRS(thiis number is used in place of SS#) I actually used our Taxes at our AOS as proof along with other paperwork.

Filing as married is also supporting evidence of the bona fides of your relationship.

Use the form W-7 to obtain an ITIN for your spouse.

Typically, the underlined statement is only true if your foreign spouse made more than the foreign income exclusion limit ($91,400).

Even though your foreign spouse has never set foot in the USA, you can file "married filing jointly". It requires filing a W-7 to request an ITIN (unless your foreign spouse already has a SSN). The W-7 requires a certified copy of your spouse's passport (got a cert stamp for Rin's at the embassy in Bangkok).

BTW, H&R Block is frequently wrong with their advise on all but the simplest of questions.

Quick question - how would my wife go about getting a certified copy of her Passport? Does that mean she just goes and take a copy and has someone where she got it sign it? Or is there some other process?

W-7 instructions are here:

In Thailand, we were able to get a certified copy made at the embassy. I briefly looked at the embassy website for Mexico City and under American Citizen Services it has guidelines on getting copies certified or notarized (the embassy won't do it). You could wait until she was in the USA and then go to your local IRS office and do it there.

Thanks, that is what I was thinking about doing, but it presents a problem as well - I would like to have my taxes done before she gets here so that I can take it down as part of the "Public Charge documents" to go along with the I-134 that I am taking as evidence at the time of her K3 visa as well. Does anyone know if my W2's and 1099s from last year will serve the same purpose? Or a partially complete tax return?

You cannot file taxes married filing jointly, UNLESS you have an ITIN number or SSN number. You have to have either one of these to file taxes.

AOS Process

May 29th 2008- AOS/EAD/I-130 Sent to Chicaogo Lock Box sent via Overnight Delivery

June 6th - Both checks cashed!!

June 25th - Biometrics appointment

Sept. 19th - Card Production Ordered! (113 days since filing)

Sept. 25th - EAD Received!!!

Dec. 5th 2008 - Received appointment letter

Feb. 4th 2009 - AOS Interview (Interviewer says going to recommend for approval)

May 15th- called and talked to an officer to submit a service request

June 10th- Made an infopass appointment,

June 15th- Info pass appointment, told me they could do nothing until the officer made their decision!

June 27 - Filed for I-131 as well as renewal of my work authorization.

July 23rd- Received I-131

Dec 22, 2009 - Biometrics appointment yet again.

January 21, 2010 Second interview

January 22nd - I-485 Touched

January 27th - Received a Request for additonal evidence.

May 27 I-485 Approved

June 13th 2010 - Green card received!

If you are married even one day in 2009, then you can't file single unless you have a legal separation agreement under divorce proceedings. You would file Married Filing Separately. H&R Block frequently gets it wrong with immigrant things. And I'm almost positive filing jointly with a spouse would be to your advantage, even over filing "Single", which you don't qualify for if you got married in 2009.

For the I-134, I sent my TY2003, 2004, and 2005 tax transcripts (Rin's interview was April 2007 - submitted P3 in March 2007). I also provided a roughed-in copy of my TY2006 tax return clearly labelled as "Draft - not filed with IRS" across the top. I included a copy of my 2006 final W-2. No problems.
