I have a question,

Can my husband (US citizen) claim a wife whose legal status is AOS (with EAD) as a dependent on his tax form?

It makes a big different in the amount of return.

Yes, as long as you're married on or before December 31, 2009. You need to include a document stating that you and your wife are choosing for her to be treated as resident for tax purposes only under I.R.C. 6013(g).

Btw, the above post is if you will do married filing jointly which will give a huge income tax refund. I may be mistaken but I don't think he can file with wife as dependent but he can file with you as married filing jointly.

no, a wife is not listed as a 'dependent' on yer IRS Tax Form 1040 .

but there is that tax filing category of 'married filing jointly' - which she most likely qualifies for, yes?
