You need to proved your W2's and income tax forms or tax transcripts to show that you make enough money to support 2 people. If you don't have other children that would be an annual income of 18212. If you don't meet this you will need to find a co sponsor

This will not be over quickly. You will not enjoy this.

can someone tell me who is "THE APPLICANT" in the "evidence which may be presented to meet the public charge provisions of the law"?

thank in advance.

The applicant is the person who is applying for the visa.

Ok, I can see this is confusing you. :blush:

A lot of monikers are going to get kicked around during this process, depending on where you are in the process and who you're dealing with. Let's start with the obvious and go from there. There is a couple who are engaged to be married. They are:

1. A US citizen.

2. A foreigner.

They decide to get a K1 visa, which is going to require the foreigner to come to the US, marry the US citizen within 90 days, and then file to get a green card.

To get the ball rolling, the US citizen has to file a petition with USCIS. From this point forward, whenever an agency of the US government is talking about the petition then the US citizen is the petitioner, and the foreigner is the beneficiary.

With me so far?

When the petition is eventually approved and sent to the US consulate, the foreigner is going to have to apply for the visa. Whenever any US government agency is talking about the visa application then the foreigner is the applicant. Same thing applies when the foreigner eventually applies for a green card - the foreigner (who is now an intending immigrant) is referred to as the applicant.

One of the things the foreigner is going to need in order to get the visa application or green card application approved is an affidavit of support from the US citizen. Whenever any US government agency is talking about the affidavit of support then the US citizen is the sponsor, and the foreigner is either the alien (I-134 affidavit) or sponsored immigrant (I-864 affidavit).

Easy, right? :wacko:
