change of status

I wanna know what would be the best thing that i can do on my case right now....

let me try to briefly refresh you about me.... i was married when i came here in america with a tourist visa.. then my exwife in 2003 obtain a H1b visa... i was then applied H4 (spouse visa) and was approved...we also have a daugther but was not with us in the state that time, she was overseas , also waiting for a H4 visa from the embassy overseas....

Then 2004 we decided to finish our marriage and was divorce that same year... in 2005 , 6 months after our divorce my daugther overseas was granted a H4 visa...and not long she came to the state... my exwife and me decide to reconciled and stay together for the sake of our daughter who was still 5yrs old.. .. the same year 2005 she did change her employer, at the same time ,extend her H1b visa for another 3 years .. together with the extension were mine and my daugther's H4 visas that will expire 2009..

Then in early 2006 we had another child together... we were so happy for the first 4 months of the year but not after that .. we then went back to our old ways ... for the past 3months before i left the house, we leave in different room.... and then i finally move out ....

Now ...right after our divorce in 2005 i met a U.S citizen we fall in love and had a good time together .. . but i sacrifice her just to give another chance to be together with my exwife for the sake of my daugther...

now i'm back with my girlfriend again and this time we are more serious about our relationship...

My question now is this ... considering that i'm still having H4 visa with my exwife, what would be the things i should do if we decide to get marriage and change my legal status with the help of my girlfriend .?

Will i have a hard time getting another visa considering my previous visa status?

pls. i need your help...
