That should be fine to leave the SIN as 0's. I would put on there that he isn't a Canadian citizen or PR. But yes, since it's your first return as a landed immigrant you have to paper file.

I'm not sure about the US income thing. :\

I have one question re: Turbo Tax and Form 2555

I've gone in and added my foreign income in miscellaneous income no problem.

Now, when I go do the Foreign Earned Income Exclusion, I'm confused.

I click, yes, for if I qualify for the exclusion.

Then it asks for my foreign address... should I put my old Canadian address?

Then it asks for my tax home - i put my US address?

Physical Presence test - I put the 12 months that I lived in Canada - so 06/06/08-06/06/09 (the date I moved to the US)?

Then is asks for my principal country of employment? US?

Then this is where I get really confused... it asks me about trips to the US... I did not enter the US in 2009 until I moved for good June 6, 2009. So I selected no... is that right?

So then it asks me about the adjustment....It lists my foreign income that I added... do I need to include a wages adjustment?? The figure here drastically changes my refund amount...

Then I'm guessing I skip the next few sections about housing... and I get to...

Exclusion Adjustments - do I add anything here?

Question regarding my Leaving Canada Return:

I have not attended university since 2007. I have carryover amounts both federally & provincially for tuition, education & textbook amounts. I have done (not printed or mailed yet) my return via Ufile but my non refundable carryover amounts were not prorated, just my personal exemptions for Fed & SK. It looks like this year I can actually use ALL of my carryover amounts because my 2008 income was not high enough.

Do I need to prorate these amounts & input on Ufile based on the date when I left Canada? (09-21-2009) The emigrants guide says JUST the tuition amount can be claimed for the part of the year I was a NR. It also says I can claim tuition, education and textbook amounts for the part of the year I WAS a resident.

I wish I could claim SK tax credits....I have a 10K grad tax exemption unused & SK graduate retention program certificate :crying: Oh well...the price of love! :lol:

The SK information says this: (but none of those lines deal with tuition amounts)

If you prorated any of the amounts you claimed on

lines 300 to 306, 315, 316, 318, 324, and 326 of your federal

on lines 5821 and 5822

I used H&R Block, but yes, I was in the same boat as you and included my wife's US income on my return...and got a much nicer return than I was expecting. I was thinking $600 or so, but wound up with over twice that...and I think it's because of her income.

I am using Ufile too. If you are eligible to claim the spousal amount (line 303) then your spouse's income must be reported. On the ufile sidebar underneath spousal income information their is a link called Controls. It will ask you "Are you eligible to claim the spousal amount (line 303) on your return? "< select >

-Claim if otherwise eligible

-Do not claim the spousal amount

I entered do not claim the spousal amount and my refund does not change whether I put my spouses income in there converted USD to CAD dollars. My husband has never lived in Canada though, so I suppose it may be different.

left august 21st 09

- worked for 4 months and 2 weeks in canada before leaving

- no ei or anything like that

- No american income for 09

- T4 is not being supplied by former employer, did not recive pay stubs, bank account was all online and is closed.

- Have T3 for intrest on stocks which was cashed out before I left, mailed to me after I arrived ( already converted to american $$ ) and placed into a 12mo certificate in american bank intrest being rolled back into the main amount. ( not collecting any money from it until the 12mo is up)

How do I do this? Iv read all 9 pages of the thread, im totally confused as I have 0% brain capacity for any of this. Previously everything was done for me by H&R block, just dropped my papers off and they did it all and I got my return in the mail.

All I have so far is that minnew says I need to claim my canadian income on my husbands taxes somehow. My income was below lines to file in canada, and likely really below lines in america when its converted.

:help: so lost.

I hope CRA can get you a copy of your T4 before April 15th. I do hope your employer is penalized for this unnecessary frustration if in fact it is their wrong doing & not a failure by Canada Post.

Yea I have been going over page after page in that thread and reading links and stuff that people posted but I cant really find anything in my situation. Specially with the no T4 the T3 and needing to file tax with my husband to get the house credit and stuff.

I found a thing on part of a link to the CRA someone had posted that said you dont have to file tax in canada if you dont owe taxes and if you dont want a return if you payed to much taxes. I dont owe taxes, I dont think I can collect GST and my returns are so tiny they dont even cover the cost of H&R block fees so I dont really need my canadian return... But i have to claim canadian income on that stupid thing with my husband of which i have no proof so it just goes round and round and round lol. Im so frustrated im about ready to say screw it come get me government if you are really that interested in someone who made very little money and owes no taxes.

Hello all:

My husband is filling his taxes and he is confused with the questions related to me.I hope someone can answer this question;I'm sure it's very simple for those of who've done it already.

I'm a Canadian and will be moving to US in Apr,2010;never lived in US yet.

We got married on Mar 2009

I've got my CR1 visa on Feb 2010

Hubby is US citizen.

For the entire 2009,I didn't have any status in US other than being married to a US citizen.

When he files his taxes for 2009,does he file as a single or married?When he checks box for "married",he gets all these questions about my SSN,Tax # etc... which I don't have any of them.How can he skip these questions?

I am working on our U.S. tax return, last year we had a tax preparer do it because of the forgein income but I hate to pay them again so trying to figure it out myself. I think I have it all figured out except for converting my canadian income and tax already paid. (all my income is forgein) into U.S dollars. I know that there was a post on here saying that we can find the exchange rate for 2009 on the Federal Reserve website but I have looked but can not find anything. Can someone please tell me exactly where to look?
