Actually that is where you are wrong. Being gay isn't illegal, homosexual conduct is illegal. Very different things.

Not at all. There are two aspects to criminal/illegal conduct, which have to coincide at the same time. Actus reus and mens rea.

1) You have to commit the act which is illegal (ie: snorting coke, having gay sex)

2) You have to have a guilty mind in doing so (ie: you wanted to snort the coke, you wanted a guys ####### in your butt)

A person can be in the military and want to smoke crack or suck a mans balls, but this does not make it illegal. They have failed on one of the aspects - the action.

A person in the military can be raped by a person of the same sex, and while this is homosexual conduct, they are missing the mens rea, and again this means that they were not behaving in a criminal/illegal way.

I have no doubt there are plenty of homophobes in the rank and file, therin lies a big part of the problem, so until there arnt, gays should not live in close quarters with straight men.....which probably would exclude them from the military.....but so be it until the climate changes and straight guys are comfortable with it....

Most people in this country and most certainly the vast majority of people in the world ARE uncomfortable with Homosexuality to put it mildly.
