it is in the ucmj. and it has a broad application too - basically anything not genital to genital between opposite sexes is sodomy.

They are pretty specific actually. . . . . I guess if they signed up aware of the policy and acted against it they should have been reasonably aware it could lead to their discharge if discovered.

I Still think being gay doesn't mean someone isn't a suitable soldier, but that's another argument for another day.

The UCMJ was passed by Congress on 5 May 1950, signed into law by President Harry S. Truman, and became effective on 31 May 1951. The word Uniform in the Code's title refers to the congressional intent to make military justice uniform or consistent among the armed services.

article 125 - Sodomy

Article 134 offenses include disloyal statements, abusing public animal, adultery, bigamy, bribery and graft, drinking liquor with prisoner, fleeing scene of accident, fraternization, gambling with subordinate, et al. It’s colloquially referred to as the “Write your own law” or “Don’t be stupid” article, and reflect acts that are not specifically listed, but nevertheless committed, by military personnel that negatively impact the service, unit, etc.

If you are sharing a foxhole with another soldier of the same sex and in the heat of a battle , it is doubtful one would be thinking about genital contact then, IMO.

The military is a very unique environment which is exclusive by it's very nature.

Forcing men to bunk and live in the tightest quarters with other men..... who are welcomed to enjoy sex with men is distracting at the least.

It seems so easy to just blurt out _whats the big deal_

But the truth is, it is way more complicated than that.
