Hi everyone again!

Thanks very much for all your help and suggestions.

I am really beginning to get annoyed with this process now. So I went again to visit the Social Security office here in Keene, this morning. Having seen all the suggestions by everyone, and printing out the necessary documents, I again explained my situation and that I wanted to get a social security number. I began filling out the SS-5 application form and was then called over where I was given a print out stating what 'evidence of lawful alien status' was required by the SS office to get my SSN.

The print out reads as follows:

Evidence is either I-94 showing K-1 staus for at least 90 days, or I-688B showing "274A.12(A)(6)" as Provision of Law, or I-766 showing "A-6" as Catergory). See EM00009, 2/11/00.

I took along my stamped I-94 card (stamped at POE on 22nd Jan 2010, until 22nd Apr 2010) which was inspected only for the social security officer to say that I needed to be in USA as K-1 status for at least 90 days before I could apply for the SSN. She also said that I needed one of the other 2 forms listed above. I also tried to explain from the above statement that only 1 of the 3 documents listed would be needed as proof of lawful alien status.

Having no idea what these forms were, I came back home and checked on the USCIS website, only to find out that these are sent after I have filed for AOS.

This is the second time I have visited the social security office and am beginning to get rather annoyed. Me and my fiancee are planning to get married next friday in NYC and need this to be sorted out ASAP.

I guess theres nothing really else to suggest from everyone, I intend to go back this afternoon and get them to sort themselves out.

You need to either try another office or ask to speak with a manager at that office. I would be asking the manager why they are following a ten years old Emergency Message and not the current POMS section RM 00203.500C1.

Well, after visit number 3 to the social security office, I finally got the answer I was looking for! I yet again explained my situation to the lovely woman behind the counter and she clearly explained that i'll have to wait at least 10 working days for my details to be available on the computer system (this was mentioned in an earlier post on this thread). It was very nice to finally talk to someone with half a brain cell!

The unfortunate thing is that 10 working days from my arrival in the States will be this Friday......ONE WEEK before our planned mariiage in NYC. Luckily, nothing has been booked allowing us to change our plans, should we need to. AAAARRRRRGGGGHHHHH!!!! :-)

Oh and by the way, this was the Social Security Office in Keene, NH.

From your timeline you got here on January 22nd and it's 10 calendar day to allow for your arrival to be entered into the DHS database, which would be today. Did they accept your application and try to verify your status? If they didn't you really need to either go to another office or speak with a manager. I agree you found someone with half a brain.

Yes, since 9/11 things have changed a lot. Now a child of a L-1 would be an L-2 and pretty much out of luck on being assigned an SSN until they would file for permanent resident status and then they could be issued an EAD card.

I was an L2, dependent child of an L1. And I needed a SSN to be included in my father's insurance coverage. You cannot become an LPR until you have been issued with 4 consecutive L1/L2s, so after 8 years as an L1/L2 visa holder. After this, you are forced to apply for a GC. Since I was over the age of 21 at the time they applied for their GCs, I couldn't be considered for one.

At the time of receiving my L2 I was both of legal age to marry and obtain a driver's license. As the state of NY requires you to have a SSN in order to obtain these things (to the best of my knowledge) and as the L2 gives you LCR status, I don't see how they could refuse to issue a SSN. Granted, my license would have been restricted to the expiry date of my L2.

Would be interesting to hear from someone who has recent experience of L1/L2 visas to comment on whether they were able to obtain SSNs for their children. Maybe a question for a different forum for ex-pats, since most everyone here is experienced in relationship-based visas :D

What an eejit she is! Honestly, if you waited until you'd been in the US for 90 days before applying and since you need a SSN in order to get your marriage license, you'd be in breach of your K1 requirements of you to get married WITHIN 90 days of arrival. Talk about not being able to interpret your own agency's regulations. The I-94 needed to ALLOW 90 days entry, not for those 90 days to have expired.

And as a PP said, why are they insisting on using an outdated guide when you presumably showed them a more recent one.

So - they tried to find you in SAVE database, and you weren't there.

Go Back EACH DAY, in the afternoon - say 3-ish, and keep applying.

Some Day Soon - you will be FOUND in the SAVE database, you want to BE IN THE SSA office for 'that day' instead of waiting at home.

My magic number is '13 days past POE date' - but there is loads of variance on that, also.

Be Diligent ! (yet polite) - remember - you are training SSA personnel - on yer own dime (how much is your time worth? )

THIS IS ABSOLUTELY WRONG.

You only have 90 days worth of status anyway, from the I-94.

The 'staff member' you dealt with is stupid, and no - I ain't apologizing on behalf of anyone.

Can you find the OTHER SSA offices in yer area? GO THERE, instead?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

You might also find that you don't really need an SSN to get married. AZ had a place for us to put Nik's SSN, and we just said he didn't have one, and the lady said OK, and we left it blank. If you can, it might be worth a trip to NY to see is you can get the license without the SSN. Mostly, they just want you to prove your identity and birth date.

In fact, there was a thread recently about this, and I think it's actually not legal to require the SSN any longer, and only a couple states (I don't think NY was one of them) give people any trouble any longer. Maybe they haven't updated their website?

True. My husband and I were married in NY state 2 years ago. He didn't have his SS# and we had no ptroblems obtaining a marriage license. Read the following from NY to see what forms of ID are needed to obtain a marriage license:

There is no mention of SS#.

you dont need a social security number to get married in NYC. I just showed my passport and they gave us our marriage license and yesterday we got married.
