Sorry for the news -

this is a white slip 'denial' at GUZ - there is no 'appeal' process in Guangzhou, but if you care to wait another 18 months, the petition MIGHT (and it might NOT ) wind its way back to USCIS, get re-affirmed, and sent back to GUZ. It's really IFFY for 'that process' to get engaged, alas. The appeal process is not really an appeal - it's re-affirmation . I don't want to mince words in regards to bad news, though :(

I see 2 paths from this point, both ignoring any 'further work on the current petition'

1. file a new K-1 - front load it with relationship evidence. or

2. go to china, marry, file I-130 petition front loaded with bonafide marriage evidence.

Ask her to scan in the documents she received from the Consulate, email them to review, you review them.

It may be something else, but it's good to know exactly what it is, so you can do something for the next petition.

Also - ask her to tell you EXACTLY how the interview went - the questions asked, her answers, and the VOs dialogue during the interview.

If you want to file a new K-1 - there has to be some proof that you two have met within the last two years - if it's been more than 2 years - you'll need to make another trip to see her.

Hey Craig, sorry to hear the news.

Unfortunatley some consulates/embassies require quite a bit of proof to be convinced of bonafide relationship. As Darnell mentioned, best to know exactly what was asked and said at the interview and exactly what the paper she received says.

There are two significant and different steps to the process. The petition for K-1 (I129F) is relatively easy to get past. The problem after that is convincing the embassy. That is where the difficulty is. I know Vietnam is a difficult consulate and the more visits the better your chances. From what I understand Guangzhou is every bit if not more difficult. We were very lucky, I visited four times in 09 and was there at the time of the interview. Even though we were confident we were still worried to death. Seen two many similar cases go either way without much reason.

Not sure how many times you have met in the past but either way you go, if you did the K-1 again or do the K-3 or CR-1 route, you will still need to convince the embassy. Best way is to have actual verifiable time together. The more the better. Our hearts go out to you. But its not the end, there is no strength like the strength of two hearts beating together. Let us know what you find out and stay strong!

I think we will go for the spouse Visa.

I think if we keep playing with the K1 maybe just waste of time and money.

So I would need to apply for I-130. After we are married?

I will be sure to have enough proof of a bonafide marrige.

I will go back to China in april or may.

About how long is the K3 and Cr-1 process?

Go CR1 route, takes about the sametime as the K-1.

About how can I start that process, I mean after we are married ofcourse.

I will discuss this with my fiancee.

About how often are the CR-1 s Denied?

kinda hard to tell, learn what happend with your K-1 and apply the fix to the CR1 (ex.they doubt your relationship) in this situation you would send in more phone records, chats, emails (if you don't email often then start now) and vist her more often (if possible) and take more pictures.this is called front loading, you are givng more information up front then you are givig during the interview.

Maybe have her bring a large suit case with 100 times more evedence.

On the I-130 they say to use Joint ownership?

I dont own a house in China and she rents a apartment.

Also say we can show co mingiling of finacial resources? If we open a joint bank account will that help?

joint bank account is good, you don't neeed to own a house toegether besides since you are American you can't buy property in China (at least not easy) stick with the basic joint stuff for now. Joint bank account is a good start.

Being in the same boat (or rather, TO BE in the same boat?), i like to get as much info as possible as to how to avoid a denial.

You have some time to plan for this type of evidence. Don't worry about owning a house in China - focus on getting her name on a lease document, utility bills, in USA, later, instead.

Ok thanks.

Yesterday I talked with my fiancee.

Im tring to tell her not to give up.She thinks its just bad luck she failed the interview.

And also I think the officers are sexist. Because she told me that the girl before her. had a man officer inteviewing her. He only ask 3 questions and thenm she got the Visa.

Yet my fiancee had a woman inteviewer. She first asked her how did we meet?

and about my job,my house, my address.

She answered all of these correct.

Still no Visa?

The other girl was only asked about his finace.and Job.

and asked for tax returns. and then gave her the Visa.

Is it just me or is the Embassy un fair.

Or is it because I only make 25,000 a year?

which is above the poverty line.

IMO, something was 'scant' in the casefile, and the VOs decided to deny based on what was missing.
