Well I wouldn't say it wasn't a denial. They don't send it back to the USCIS for review, they send it back because they believe he wasn't eligible for the petition, and that usually means that they are suggesting that the petition be revoked. They can refuse to give him a visa, but they can't revoke the petition. If this was basic AP they would send it to the DOS, not the USCIS. I think they are just trying to blow smoke up your azz.

so...does anyone have an idea of what will happen next?....i don't understand why they lied and said sending it back to uscis for review....does that mean they're sending it to fraud investigation unit?...i know one thing..i'm gonna fight the SOB's all the way...they better have damn good proof...i'm not a stupid woman and i know my husband more than some idiot CO who knows absolutely NOTHING about me or my husband....

in fact...i'm gonna send a letter to uscis ASAP.....

in fact...i'm gonna send a letter to uscis ASAP.....

i have a feeling this whole thing is because he didn't know much about my first husband...i don't like to talk about that marriage..my husband knows this..i've told him a little of what happened..i was young, the marriage didn't last long because he was very abusive...i couldn't even tell you the exact yr i married the jerk cause i tried very hard to forget i ever married him so how can these idiots expect my husband to know the exact answer when i don't even know myself....this whole thing is completely stupid..

how can this even be fair...they expect spouses to know every single little thing including how many hairs i have on my head....why don't they ask the families of american victims who were murdered by their american spouses of 20 plus yrs. if they really knew them?....really, this is ridiculious....

I guess your next step would be to have your representative find out the diplomatic pouch number so that you could track the progress. You will need the assistance of your rep for the remainder of the time, so ask for their assistance to check on the case periodically so that it won't fall between the cracks. I had ours check on the status every 2 weeks.

Perhaps you could plan a trip to visit him in the near future. You both need something to look forward to until this mess is worked out.

they gave us the pouch number in the email...where do we need to go to ck on the status?...uscis?...i'll ask the senators office to help keep track of where it's at...i'm completely clueless with this part of the process...will it return to the service center we went thru or another unit?...i'm not sure what exactly we need to be prepared for.. :wacko: ....

actually..i'm considering staying here with my husband for a time..lol..my hubby's family is hoping i will...we've been thru hell being seperated..and i'm tired of the whole "upset at the airport scene"..it was awful the last time and i don't want to go thru that again....my mom's already set to be a co-sponsor so i'll b ok in that dept.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Unfortunately, you are dealing with the US consulate in Morocco. Even though there are many of us who have valid relationships and marriages, this is a high fraud post. While there is a great number that have had no problems with this consulate, returning petitions/applications is how this consulate is fighting "suspected" fraud. You could have the most solid original submission with high quality evidence and the consulate could still refuse the visa and return the petition/application to the USCIS for further review on mere suspicion or some doubt the CO has.

There is quite a bit of information linked to from my VJ signature, including what happens to a returned petition/application. I would suggest reading the first link: ~ Returns & Refusals...What They Don't Tell You ~. This will give you an idea of what you can expect during the return process, and some pointers of what you can do while you are waiting.

Are you planning on visiting Morocco soon? I understand you were there for the interview even though they didn't let you in. One thing the USCIS is going to look for when your file is reviewed, is whether you have spent any time together since the file was returned. I don't know if you're still in Morocco, or have already come home. If you're still there and can possibly delay coming back to the US for a bit, it would be a good idea. If you have already returned to the US, I would try planning another trip as soon as you can swing it.

Even though every case is different, and there are different reason(s) for a return included in CO memos to the USCIS (many are flimsy at best btw), you can get through this. Unless there is real evidence of fraud, misrepresentation, or your husband has a criminal record or other real ineligibility to receive a visa, you can over come this by rebuting the NOIR/NOID on time and to the satisfaction of the USCIS when the time comes. There are many of us who have been through this process, and are together with our spouses here in the US living happily today.

hi..thanks for your post...i've read some of your posts and it has given us great info into all this mess...I'm still in Morocco..even if my husband had gotten the visa we had planned on being here for a little...i've decided to stay here for a while for some much needed alone time together...
