yesterday my hubby was out and out denied while i stood and watched alot of k-1 people and women come out the consulate smiling and happy...what a crock!!!

no ap/ar...they said they were sending it back and didn't believe my hubby....i went to the window and of course they wouldn't let me in to speak to anyone...i called all my state rep. right away and the consulate called and gave us another appt set for next week....

i am very angry about this.:angry: ...more than angry...someone from the govt needs to look into what is happening at this consulate...alot of good honest people are getting denied for no valid reason...

what i would like to know is...if anyone had this occur in casa and what was the outcome of their second interview? also if they can put us in ap after a denial or have to approve it or what?...we are not sure what to do now....i want to be one step ahead for whatever happens...does anyone have any input on this type of situation?....and how do i file a rebuttal if it is needed?

hubby told me that the CO went and returned several times to talk to another CO...he was going to put us in AP at first then after he spoke with the other CO he returned and said denied...

any help and advice will be greatly appreciated alot.....thanks everyone

Did he receive the 221g? You need to make sure what notes are made. Hopefully it is just AP, but if it is a returned petition there is a topic pinned at the top of this forum that gives you a wealth of information. Also if you look at Kiyah's links it also gives you a lot to go on.

This is a CR1, so it will not expire, you will have to ride it through to the end. You first step right now would be to try and get the petition to stay in Casa. They might lie and say it was already sent back, but this is not immediate. So ask your congressman to assist you to keep it there long enough to give them what information to prove whatever their doubts are are false.

The next thing is to figure out why they don't believe the relationship and provide them (if they will accept it) with whatever proof will ease their doubts.

Just so you know these things can be won. We fought it and won. It took an additional 15 months after the initial interview before he got the visa, so it isn't going to be quick unless you can stop the petition from going back. But yes, it can be overcome.

yes..its a 221g but it states that they are returning petition and application back to uscis...i am here in casa now with hubby...i called my congressmen right away yesterday and they called the consulate right away...the consulate then called my hubby about an hour later and told him to come back next week..there was nothing on the form to say why they denied it...from what hubby tells me the CO was asking another CO what to do...he was going to put us in ap until he spoke to the other CO

Just so you know, it is rare for the consulate to give you a second chance. So think through all of the questions that was asked of your husband. Think of all of your possible red flags. Pull together as much documentation you possibly can to take to this interview. Letters of approval of your marriage from both of your families could be beneficial. Don't waste this opportunity. Take it very seriously. If they send it back it is a very long and grueling process.
