Hi All,

Too bad I have been away for a while, I was more than frustrated with the whole process and just decided to be quite. Suprisingly I was approved on the 15th of july after a very long wait. The good part is I applied for the I 129 and I am now with my hubby in the US.

How long does it take for the NVC to pass on the case to the consulate?

Thanks

Wow, your I-130 took forever. Are you doing AOS or are you coming back to Canada for the CR-1 interview? If you are coming back to Canada, you'll have to do all that mailing back and forth with the DS3032, I-864, DS-230 and fees etc at the NVC level before it can be forwarded to the consulate.

CR-1

09/16/2005 Mailed I-130 (CSC)

04/13/2006 Beneficiary receives DS-230 (Day 208)

05/10/2006 Beneficiary sends back DS-230 and docs to NVC via Fedex (Day 235)

05/19/2006 NVC issues RFE on Question # 20 on the DS-230. (Day 244)

Congratulations! At least, you guys are together. Have you started the AOS after you had arrived with K-3 visa? I guess, you can go back to your I-130 interview or continue AOS here. The NVC process for I-130 can take upto 3 months.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

Congrats on the approval finally

Am not sure by your post if you have completed the NVC process or not as you just ask how long it takes NVC to pass on the case to the consulate.

If you have not yet done the NVC process with the approved I-130 you now have a choice as to whether you wish to adjust status from the K-3 in the US or continue with the I-130 and return to the consulate in Canada for the CR-1 visa. If returning is a viable option then this is the better course of action as the AOS process can be the biggest pain in the azz and more time consuming.

The NVC process itself will take 2-3 months depending on if you use the timesavers/James Shortcuts and if there is any hold ups with name/security checks. Once complete at NVC it can take anything from a couple of days to weeks for NVC to forward the case to the consulate.

All the best to you both and your future together.

Thank you all for your replies, I have not filed for AOS and don't intend to, impling I am going to continue with the CR1 process, to me 3 months is not much considering I had to wait for a year for it to be approved in the first place, and the good part I am together with my husband. I guess I will just be patient. Thanks

NVC process can take upto 3 months depends on how quickly you mails out the forms. You can use some shortcut to save time. First, wait for NVC to assign a case number for you which would be 1-2 week after the approval date.
