Hello! I am new to VJ and excited about this new resource :) I have a question-

My fiance arrived here in December and we got married on 12/31/09. We are in the process of filing for an adjustment of status, but in the meantime, I am ready to file my taxes for 2009. I cannot do this without my fiances SS#, which of course he doesn't have yet. Any like experiences out there? Although I am SOOOOO grateful my hubbie got over here, I am learning the process and paperwork is not done :( Thanks for your help!

Sorry, but I am super ignorant when it comes to the paperwork. I used a lawyer for the K-1 VISA and had everything done for me :blush: Where do I apply, and with what form? Thanks for any help!

1. Your fiance was eligible to get a SSN the moment he stepped of the plane. If there is less than 14 days remaining on his I-94 you will have to wait until he has a green card or EAD. NOTE TO OTHER VJers...get your fiancees SSN before they unpack their bags. think I repeat this many times every day, the SSN is important and valuable for MANY things...AOS is not one of them, but it should be the FIRST thing a K-1 does. Always get the SSN in the name exactly as in the passport, names can be changed later, the number never changes.

2. He does not need an SSN to file taxes. Simply write "Pending" in the space for SSN and MAIL your income tax return. You cannot file electronically without valid SSNs for everyone, but you can mail a paper return.

Lawyers are a wonderful waste of money and oxygen aren't they? Why on earth would your attorney not give you a guide for this. On can only hope you will waste no further money for the AOS on this data entry clerk.

Go to ANY Social Security office in the United States and they have the forms there. He will need TWO forms of ID. His passport is ONE and his K-1 visa is TWO. The I-94 is another accepted form of ID.

A k-1 is eligible for an SSN from day ONE until day 76 of his/her arrival inthe USA. There MUST be 14 days remaining on his I-94 card. The SS aministration is full of ignorant, untrained clerks who do not know this. DO NOT leave the SS office until his SS number application is accepted. Ask for supervisors (go up as many levels as necessary) until you find one that has been trained. Here on this site in the guides, is a copy of the SS Administration's policy on K-1s ans SSNs. You can print it and take it with you to train them if needed. IF they say you have to wait, even ONE DAY, they do not know what they are doing! Get a supervisor. You do not need to wait for anything, the application should be accepted and you will receive the number the next morning. Anything else, any other response...means they have no clue.

The SS number will be generated overnight, he can go to the SS office (or they may give you a number to call) and get his NUMBER the next day. The card is not necessary for anything, only the number is important. It will take two weeks (at least) for the IRS computers to rectify with the SS computers and log his SSN in the IRS computers. After this time you can file an electronic return. You can file a paper return today. IF you file a paper return with the option to have direct deposit of your refund, it delays the process very little...probably less than the time it will take for the IRS computers to catch up.

Won't work. If you cannot get a SSN by the time you file, you will need to submit a W-7 along with your paper return. The W-7 request is for an ITIN (individual taxpayer identification number). Both the return and the W-7 are mailed to Austin, TX, the ITIN assigned and the return forwarded for processing. It will require a notarized copy of the immigrants passport.

Thank you for your clarification and info! I'll be going to the SS office this week as my husband has plenty of time left on his K-1. So glad I have some guidance now, lol!

AOS Process

May 29th 2008- AOS/EAD/I-130 Sent to Chicaogo Lock Box sent via Overnight Delivery

June 6th - Both checks cashed!!

June 25th - Biometrics appointment

Sept. 19th - Card Production Ordered! (113 days since filing)

Sept. 25th - EAD Received!!!

Dec. 5th 2008 - Received appointment letter

Feb. 4th 2009 - AOS Interview (Interviewer says going to recommend for approval)

May 15th- called and talked to an officer to submit a service request

June 10th- Made an infopass appointment,

June 15th- Info pass appointment, told me they could do nothing until the officer made their decision!

June 27 - Filed for I-131 as well as renewal of my work authorization.

July 23rd- Received I-131

Dec 22, 2009 - Biometrics appointment yet again.

January 21, 2010 Second interview

January 22nd - I-485 Touched

January 27th - Received a Request for additonal evidence.

May 27 I-485 Approved

June 13th 2010 - Green card received!
