MY HUSBAND INTERVIEWED YESTERDAY 28 JAN.2010 IN CASABLANCA MOROCCO HE HAD A RUSSIAN SKINNY LADY POSSIBLY RED HAIR DIDNT HARDLY LET HIM SPEAK HANDED HIM A WHITE PAPER SAYING REFUSAL AND IS GETTING SENT BACK TO THE USCIS HAS ANYONE EXPERIENCED THIS ???? ALL HELP IS GREATLY NEEDED

Have you tried to contact your congressmen? Maybe they can step in ASAP and stop your case from actually returning to the USA.

I contact my senator before Bijad even had his interview and I think that helped out.

What was the reason for the refusal? If it was a relationship for immigration purposes then you may be able to get the petition held to present more data. If is was misrepresentation then you will probably need a lawyer.

Denials do happen, I am sorry it happened to you.

Why was he denied? The paper he got would say.... We need to know the details in order to give advice. For example, if he was denied because they think it is not a bonafide marriage, what evidence did you send in? Did he get asked any questions he could not answer?

Also, you are posting this in the K3 forum. Did you only apply for K3 or for the CR-1 too? If both, you may be able to re-start the CR-1 and get another interview (this would be much faster than appealing or starting afresh), though of course the reason for the original denial would still need to be overcome.

After Interview Results

If u get a paper with box check (saying return back USCIS) i know u are upset! like me

first thing

call your congressman go right away , sign a paper for them to help try to stop it before it gets sent back/ do it the same day/ if u can..

Email/ivcasablanca@state.gov= asking them why was it was sent back etc..

So far here are the step's I have taking and good Advice I have gotten / DEC 14/09 interview

1, call congressman/ results they will try to keep it there /but it was sent back . (Local Congressman in your city area) now wait

2,Call the consulate on way they treated him with disrespect...(Ellen Conway the numbers to reach her is 202-663- 1153 or 202-663-3579. and filed a complaint about the way your fiance was treated by the Embassy during his interview. )

3,Then u will have to wait about a month for it to reach back to NVC then call them.

NVC 202-663-1225-,(ASK WHY WAS IT RETURN )

from what I got out of NVC supervisors! is when its return (for further review/relationship) not a denied is a good thing! give u a chance, to see what they want more (in case be fore making a decision)

4, Get all your phone bills/cell/textmess/famliy members=letters whom they talk certified it.anything u have to prove the relationship/ the date u met him until now/and he will need to do the same make sure he send it to u in email so u can print it etc... (NVC supervisors was very helpful she told me this) (ask for me we paid oovoo so he can call me any where any phone/so if u got a plan like this all u have to do email them or call them to ask for the bill make sure all the numbers r on it/oovoo is good its so i got all bill sent he call me and all my family for 1 year,,

Get this all ready/ before they tell u what u need so u can have what u need and send it to them fast./and you dont stress or forget something ...

now u just wait for the USCIS reply ( be warn once its sent back to uscis they have 120 days to reply) yea the number time is upsetting..

Sorry this happened to you. You should try to go to the MENA section and search for the pinned thread about returned petitions. Quite a few VJ members have had success in getting their SO to the US after a 221(g).

Try to find Kiyah here on VJ she is great asset to VJ and can help guide you.

If possible can you give us the reason for the CO used for the 221(g) and try to have your husband tell you EVERY question asked. Trust me it does matter.

The K-3 has an expiration date and more often than not USCIS will not even contact you for RFE instead they may let it expire. If you have not contacted your elected official do so ASAP. It is likely too late to stop it from being returned but the note will be in your file that they inquired on your behalf and you can use this when you get the chance for round 2 with the CO.

Try to search also for attorney Marc Ellis here on VJ he has helped a few people with compiling their rebuttal packets.

IMO...Do not rush to file the I-130 if yo have not done so already. Let the K-3 expire or wait to see if USCIS contacts you because as Ellis will tell you USCIS will deny the I-130 because you "ignored" the I-129F.

I have read worst here on VJ. The CO says things to rattle the SO so just have to tell yourself that it's not personal. Hard I know but only you and your husband know the extent of your relationship. Outsiders looking in can only assume.

So the paper clearly says it is being sent back with a request to deny? It is weird if the reason is due to your income. I have not heard of this excuse before. But then again in Casa they are pioneers in excuses.
