Hi everyone. I am from the Philippines. My petition was originally approved last August 1999, I was 19 years old then. Now, I just turned 30. I am not married (because of my petition) yet but I have a 2 year old daughter. Her mom is in Japan. Last January 6, 2010, I received a letter from NVC regarding my petition, and that it can now be processed (after more then 10 years). I've sent the COA DS3032 back to NVC and my dad paid the Affidavit of Support (AOS) Processing Fee. After 10 days, we received the Immigrant Visa Application Processing Fee invoice of $400.00. These are my questions:

1. Can I bring my daughter with me once my visa comes out? Or should I start letting the embassy know that I want to take my daughter with me? What should I submit?

2. How many months will it take for my visa to come out?

I tried using the search feature but I was unable to see similar cases, sorry.

Would be likely that you can bring your duaghter with you, as long as she is under 21. You would want to check with the embasy, but normally when a parent files a petition for a child then their grandchildren would apply as dependents on your visa. So your daughter should be able to come with you, provided this was a parent petitioning for you. A seperate petition is usualy only needed when the person qualifies as your direct relative (Such as your husband filing for you, then he would file a seperate petition for the child).

That would be the approval date right? For the prioity date you would go by the date he filed the petition. When he first mailed it to us basicly. Do you know that date? Also is your father a perm. resident or us citizen?

That would be the approval date right? For the prioity date you would go by the date he filed the petition. When he first mailed it to us basicly. Do you know that date? Also is your father a perm. resident or us citizen?

Sorry for the confusion.

He filed the petition more than 10 years ago.

I'm holding a letter here from the NVC (which I kept) dated October 1, 2001. Letter was pertaining to visa numbers that are not presently available and that my registration has been noted.

It has my Case Number, Preference Category, My priority date which is August 16, 1999 and Foreign state chargeability.

My father is a legal permanent resident up to now.

Ok so it has your prioity date of August 1999. According to the visa bulletin, they are issuing visas to people with a prioity date of July 15th, 1998. So im wondering if your prioity date is actually August 1999 or If its sometime in July 1998. Basicly if the prioity date was current it can take up to 4 months perhaps before they will invite you to apply for the visa. Now if you do have a prioity date of August 1999 it could take up to another year perhaps to get the interview for the visa. This is all provided nothing goes wrong or is sent back to USCIS. Just a basic estimate, more of a USCIS Expert then Department of State I suppose! Haha.

I was just curious why they have sent me these forms thinking that my priority date will be "current" a year from now. Do they do this often?

Has me wondering for myself also! If the national visa center still has your case, you may be able to contact them regarging this, phone number 603-334-0700. Haha, I would have suspect they would usualy send these forms and notifications to someone that has a prioity date current. But then again, they may be trying to get you processed and ready to go so when the visa does come current you can immigrate with it with out having to bear it being current and waiting! lol .. You'll get over here eventually, hang in there!

not too often.. =) in my case they sent DS 3032 about 4 months before my PD became current. Just continue with the Affidavit of support form/s and DS 230. I think your daughter should have separate DS 230. =) Inform NVC by email or by calling them regarding your daughter.

Pending in AOS form (I-864) and pending IV fee.. :whistle: =)

We're not really sure if my brother and I can immigrate with our dad because we're over 21 years old now.. :crying:

Maybe it's only dad.

I'm just collecting all our documents now as well as the ds-230 forms.

Our priority date is January 2006 which was current last month.

We had received letters from NVC starting October 2009.

Did you already called the NVC?

Or did they already sent your dad AOS forms?

It is much faster to pay those fees online, then print the coversheets and download necessary forms.

(AOS forms for AOS fee and DS-230 for IV fee)
