Timeline

my friend wants to marry a guy from england.Should she have him come here on visitor vist and them marry.Or should she go there and marry marry then return to us and let him apply for her to immigrate to uk.

Yes, coming here to get married AND then go back home is legal on a visitors visa, coming here to marry, and staying to AOS, not so much...

Or should she go there and marry marry then return to us and let him apply for her to immigrate to uk.

Once you get married, either way (coming to US then going home, or your second choice) you would put in paperwork for the CR-1.

You may even want to consider the K-1 visa, brings the person over as a Fiance then you get married, AOS

whichever route you take, they have to decide which is best.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

No to the visitor visa and marrying, then adjusting. It's illegal.

Yes, if he's going there on a visa, they're getting married and he RETURNING TO THE UK while they file for a CR1 visa. Be warned, he should bring ample proof of his intent to return to the UK (letter from employer, lease or property deeds, utility bills, etc.) because if he's asked at the border if he intends to get married and he answers truthfully (as he must!) they are far more likely to deny him entry.

No, to her going there, unless he wants to petition for a fiance's visa for her to come here. Unlike the US, you are not allowed to get married without an appropriate visa allowing you to do so. This is because you cannot adjust your resident status here (in England) as an immediate relative if you didn't have a fiance visa. They don't care that you're not planning on adjusting, they just don't want you to bypass immigration laws.

Why not apply for a K1 fiance visa for him? As long as they are both legally allowed to marry, they could start the process immediately and he'd be there in 7-12 months, if all is normal with his health and has no criminal history... I'm assuming they have met in person?

Interview Date: 9-14-10- Approved pending non-machine washed replacement passport.

Delivery Notification 1-10-11

Received notice- I-485 has been transferred to the California Service Center 2-9-11.

Doesn't anyone else read this as they want to marry in the US but then live in the UK?

The immigration process to the UK is so much faster than to the US, but we don't address that much (at all, really) on this forum.

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

they wanna marry in the uk they have decided.he doesnt want to come here and leave his mommy..omg im scared o that....yes they have met in person ,she has lived there with him for 6 months.but has returned to us.they are tryin to apply for her visa to uk now...I so wouldnt marry i guy whom wouldnt go anywhere for me.....

Hmmm, well. I wouldn't marry a man who doesn't have the balls to venture out in life and experience new things. But I know a lot of people, not just men, who think what I'm doing is 'incredibly brave'... what?! lol.

Having said that, my fiance was originally going to move to the UK but having spent 6 months here was so unhappy, I'd never ask him to come here. A lot of reasons, but the difference in personal space, cost of living, lack of sunshine, and dire absence of good mexican food were the main ones. And that's fine by me. I've spent my life moving around, so why not? The longest I've spent living in the same country as my parents, after the age of 16 is the past 3. We'll be just fine...
