On the I-864 form, it asks for my mailing address and place of residence. I am living in Mexico currently with my husband and plan to stay here until he gets his visa. I have been living here for 8 years, but yes, it's temporary. I don't have my Mexican residence or anything like that. For mailing address, I obviously put my address here in Mexico, but what do I put for place of residence?

I plan on attaching a written explanation and evidence (a lease and maintained bank accounts) to explain how I meet the domicile requirement for the US.

Place of residence is where you currently reside.

However, if you have a lease to a US address, you could use that.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I don't want there to be any information that doesn't match up. I CURRENTLY reside in Mexico. The lease for US address will be for when we move there. Should I put Mexican address then?

Yes.

I-864? I suggest you use the domicile address in USA.

You are NOT doing a DCF'd I-130, right? Stick with the USA addresses.

If you have not paid the AOS fee yet, make sure you sign up for the online electronic payment portal.

Then, no need to pay attention to any POSTAL notices (except RFEs) sent to the USA address, whilst yer living in Mexico -

you can pay attention to the Online Payment Portal, instead - for 'when to send stuff in' to NVC.

If a USA Domicile address does not make sense, then at least use the address from YOUR TAX RETURNS or BANK STATEMENTS.

Yes, I AM doing a DCF'd I-130. I'm not doing AOS. We're doing the IR-1 since we've been married for more than 2 years.

For DCF, as you know, you absolutely have to prove US domicile. In London, I know that you absolutely have to put your US address down for "residence" but your UK address for mailing address. There was a big kerfuffle a year or so ago when someone going through London put their residence and mailing addresses as the same (i.e. in the UK). It was an honest mistake but it was a pain to sort out. I assume it would be the same for Mexico. It would be great if another Mexican DCFer could pop their two cents in.

I haven't been able to find any Mexican DCF'er that is ahead of me in the process so yes, I agree it would be great!

Later on in the form, it says country of domicile. That answer of "USA", with my evidence, isn't enough?

Section 101(a)(33) of the Immigration and Nationality Act defines "residence" as the "place of general abode; the place of general abode of the person means his principal, actual dwelling place in fact, without regard to intent." Residency must be established by the petitioner when filing a petition, or by the applicant when filing an application.

I don't understand. Does that mean US or Mexico?

That is anywhere you live, you can't phisically live in two places at once, in order for you to do a DCF fileing you have to prove you are living in the jurisdiction of the consulate you are fileing to in other words taking a shortcut away from NVC and going directly to the beneficiary's consulate in this case you have to prove residence in Mexico so I would use your address etc of your place of "current" residence, never use the term "temporary" as this is a flag to deny your application and redirect you to using the service centers in the US and going through NVC. Hope this makes some sence to you :)

Since the 864 is filed after the I-130, the address can be different. When I filed my I-130, my residence was Denmark (which of course was necessary to file the I-130 as DCF), but when it came time to file my 864, I listed my US address. If you have a US address, I think its best to put that on the 864, helps establish domicile.

But at the time of filing my I-864, my address will still be in Mexico. I'm sure it helps establish domicile, but it won't be my "residence" in that moment. That's what worries me.
