work under K1 before wedding

Hi everyone

is it possible to get a temporary work authorization until we get married or i wont be able to work until we get married, "adjust my status" and go for a green card?

because ill have a little problem of budget if i need to wait for the wedding and then get the green card.

Yes, you can file I-765. http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

The filing fee is $340 but if you wait and file the I-765 concurrently with your Adjustment of Status, you won't have to pay anything else aside from the $1,010 ($930 filing fee, $80 biometrics) for the I-485. Also note that if you do file the I-765, it will expire once your K-1 I-94 expires.

euh....there is something i dodnt understand. you only talk about the I-765 with 2 different things, then you finish with the I-485.

i just need it to be clear. if i filled out the I-765 before the wedding, the fee is $340 but if i do it with the adjustement of status, it will be $1010??? and it will expire in july with my k1?

Yes but not really - as pointed out above, you can apply for it (comes with its own fee) and will expire when your I-94 does (90-days after you enter the US) - it may very well take 60-90 days to get so it is essentially worthless to you. It isn't set up for a K-1 entrant. When do you plan on getting married?

Best to get married as soon as possible then file AOS (along with EAD) - you'll pay the single $1010 fee and once you get the EAD (work authorization) it will be valid for 1-year (which is usually plenty of time to get your PR/Green Card).

Actually you can not work until you get the EAD. Sri these are the disadvantages of the K-1 process.

Sorry I wasn't more clear! ^__^;; As Otto und Karin said, it's best to wait and file the I-765 concurrently with your Adjustment of Status (I-485).

The filing fee + biometrics fee for the I-485 is $1,010. If you file the I-765 at the same time, you won't have to pay the $340 fee. So it'll just be $1,010 for BOTH forms. (You may also file the I-131, Application for Travel Document with no additional fee)

You are probably looking at wedding + 3 months assuming you file AOS right after the weding before you are legal to work

This will not be over quickly. You will not enjoy this.

You can file for the EAD when u arrive at the cost of $340. It will expire and be non-renewable when your I-94 expires (90 days after you enter the US). Because it usually takes two to three months to receive the EAD it is not worth the money to obtain it.

When you are married and file for AOS you may also at the same time file for EAD at no additional cost. This EAD is valid for one year but of course once you receive your green card you will no longer need it.

So best to get married ASAP and file for AOS.

ok so i get there, get married..normaly beginning of march, then i apply for the I-765 and pay $1.010 to get it? or its worthless because it will come out too late and then come out after the wedding where ill have to fill it out again.anyway, i might not be clear either but i understand myself on the second phrase.

But this is really expensive!!!!!! $1.010 to get the work authorization? hopefully ill get a freaking well paid job.

And long does it take for me to get the work authorization after the wedding?

Again, the $1,010 fee is actually for the I-485, Application to Register Permanent Residence or Adjust Status. When you file that, you don't have to pay for the I-765 too. Just include it with your I-485 and it'll be processed.

After you file the I-765 with your Adjustment of Status (I-485), it will take more or less 90 days to be processed.

Nope.

Goes like this:

option 1) arrive on K1, file your I-765 (EAD application) and pay $340. Wait 60-90 days. It will expire with your K1, which expires 90 days after you enter. No, you cannot file the I-765 before you arrive in the US. Get married before your I-94 expires and file your AOS (I-485) for $1010. You can't file another I-765, so you'll have to wait for your green card to arrive in order to work again.

option 2) arrive on K1, get married and file your AOS, which will cost you $1010. You can file a I-765 at the same time as the I-485 and it won't cost you a penny. Wait 60 -90 days for the EAD to come through and work for up to a year on it or until your GC arrives, whichever is the sooner.

In other words, you'll be paying $340 for maybe 30 days work authorisation, best case scenario. Worst case scenario, you'll pay $340 for 0 days work authorisation and have to wait another 5-8 months average for your GC to come through, but since you didn't get married for a while, you're talking 8-11 months average before you can work.

The I-765 that you file while you're on a K-1 visa is non-renewable and expires with your I-94. It can't be renewed because once your I-94 expires, you are out of status until you file for Adjustment of Status.
