I-864 and sponsors current employment letter?

Hello!

My American husband just started a new job after being unemployed for the past 6 months.

He's unable to submit the I-864 form to sponsor me, so his father has thankfully filled out an affidavit of support form.

I'm aware that I need a written document from my sponsors employer. So would this be my husbands fathers employer??

Also, would it be OK to have a written document from my husbands new employer to state that he is now fully employed?

I'm a bit confused, have you already submitted the affidavit of support?

It's probably best to look at this way.

Your Husband is your primary sponsor and he must fill out an I-864 and include any information/documents that are required to be sent with that form.

Your Father in law is your cosponsor, he must fill in the I-864 and include any of the information/documents that are required to be sent with that form.

It sounds like you are adjusting status based on marriage - if so, your US Citizen spouse will still need to complete an I-864 as your primary sponsor, regardless of income status. Your father-in-law will be a co-sponsor.

As far as the letter of employment goes - it isn't terribly necessary at all since many employers will not (or are unable to) supply one. If you do submit one, I suppose a hand-written one is OK but if it simply looks unofficial, I'd skip it.

He will still need to provide an I-864 - regardless of income level. (just making sure you understand that)

Does his new job provide enough income to mee the poverty level needed? If so, they will accept current income for the I-864.

You would need to provide evidence of the new job, as you noted. (if he makes enough, you do not need a co-sponsor in most cases)

Normally - for the I-864 - you need to provide tax transcripts (for the recent tax year, and you can include up to 3 years worth to help your case).

as per the instructions:

You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income.

You are not required to submitthis evidence, however, unless specifically instructed to do so by a Government official.

For example, you may includea recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income,or income from any other source, you may also include evidence of that income.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thanks so much for clearing it up that they both need to fill out the forms.

Trailmix - We haven't sent the forms off yet.

I was under the impression that the primary sponsor would be his father, since my husbands work history is limited and his current salary is below the poverty level for 2 people. Glad I have the right information now.
