Hi guys, my husband went for his medical today & they gave him a blood test & a urine test...we assume they were testing for drugs because he had weed on his police report from 9 years ago...if they found weed in his system would he be denied at his interview next week & could he ask for a retest if he felt the results were inaccurate?

could he do a retake? because he said the doctor was grilling him with drug questions and then made him take the urine test...he has not smoked for ages he said....I will die if after all of this he doesn't get approved & can't come home : ( : (

Do some research into this, because they really really frown upon ANY history of drug use. I have read of a 50-something year old couple who admitted to smoking in the 70's being denied. Another recent case admitted to trying drugs once and was denied, not the London embassy though. Criminal records relating to drugs, no matter how long you've not used, is usually not good news.

If he has nothing to worry about then he shouldn't have a problem.

If he does, then you might want to emotionally prepare yourself for filing a waiver. good luck.

I'm just wondering if anyone knows of a situation where someone could re-take the medical if they feel the results were inaccurate? It probably would depend on the interview officer...conditional?

If you're referring to a drug screen being inaccurate on a positive, I'd think that would be a very tough sell. For example, if there's a marijuana positive combined with admittance of past use and a conviction of possession....I think you see where I'm going with this.

uhhhhhhh, can't believe this...he was blind sided at the medical when they asked him to take a urine test...it doesn't say anywhere in the medical info that they could do that. And its not as if people in the US don't smoke... I don't see the big deal...I mean it's legal in Amsterdam!! The doctor was completely rude to him and asked extensive questions all relating to drugs...for no reason...just completely unfair

Did your fiance take any drugs before the medical? If he didn't, he has absolutely nothing to worry about.

If he did, is he contemplating lying about it?

It's like this...it's a medical...they look at everything...they check your bits for god sakes..if there was even the slimmest chance that they were going to take a urine sample he should have stop smoking...that's it. there's no second chance. if he fails it it's because of his own choices. there's nobody to be upset with beyond himself

There were some consulates that always checked, I do not remember a Urine test, sounds like they are being more complete now.

And I think it asks anyway if you are a drug user.

Fortunately for me they did not not test for Green King IPA.

actually on the contrary he told the truth about everything including that he had a caution 7 years ago (I know, what was he thinking) and that's prob what caused the doctor to question him so intensely and give the test...

our attorney said that if anything came back positive that he would be banned from the us for 3 years but I'm not sure how accurate that is...

it is going to totally SUCK if he can't come home next week after being apart 6 months! it is what it is and we will find out soon enough but just from a rights perspective i think it would be INSANE to not approve someone or bar them from the US if they smoked...there is a huge difference between smoking and doing or partaking in hard core drug activities... there are so many worse things to be concerned about....

I am so ready to be done with all this immigration drama....so stressful and looooooooong!!

I know of another VJer who had this happen to her in 2005 through London. She admitted to past drug use in the 1980's and had a similar experience to your fiance, then was placed on administrative review while waiting for the test results. When they came back clear, her visa was issued and now she lives in Texas.

It is quite accurate that he would be banned for a positive result. Personal feelings aside, USCIS doesn't feel that people have the right to be doing things which are, technically, illegal.
